PC69-235 BE MADE THERETO WHEREAS, the City Planning Commission of the City of Anzheim did receive a verified Petition for Variance from JOHN AND ANNE KRAJACIC, P. 0. Box 3716, Anaheim, California 92803, Owners of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Parcel 1: The South 222.00 feet of the North 288.00 feet of the East 108.00 feet (measured along the Nertherly and Easterly lines) of the Northwest o,uarter of the Nori:hwest quarter of the Northeast quarter of Section 13, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as said section is shown on a map recorded in t,ook 51, page 11 of Miscellaneous Maps, in the office of the County Recorder ef said county. Parcel 2: The L•ast :.00 acres ef that portion of the Northwest quarter of the Northwe=t quarter of the Northeast quarter of Section 13, Township 4 South, Range 11 West, in the Rarcho Los Coyetes, as said section is shown on a map recorded in boo:< 5]., page 11 of hiiscel.laneous Maps, in the office of the County RecoTder o.f said county, lying Southerly of the North 28L~.00 feet thereof, said 288.00 feet being measured along the Easterly line thereof. WHEREP.S, the petitioner submitted a written request for amendment or deletion of conditions of Resolution No. PC69-235, dated November 17, 1969, granting Variance No. 2139; and WHEREAS, by law, conditions may only be amen~ed or deleted upon the readvertisement of a variance petition and considered at a public hearing by the Planning Commission; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on February 25, 1970, at 2:00 0'cl~ck P.M., notice of said public hearing having been duly given as required by Iaw and in accordance with the provisions of the Anaheim M~nicipal Code, Chapter 18.76, to hear and consider evidence for and against said proposed amendments or deletions and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study ma~3e by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing does find and determine the followir.g facts: 1. That a hardshi~ would be created if conditions as require~j under Reso?ution No. PC69-235 were to be completed in the 90 days origi;~ally imposed, since the petitioner stated that he could not contact all of the owners of the stored vehicles, many of whom were out of the i1.S., to remove or relocate their vehicies, and th,:t the cost of improvements associated with the conditions were too prohibitive to be completed in said time. 2. That the i:ime limitation i.mposed to complete the conditions of approval under Resolution No. PC69-235, is hereby extanded to encompass 365 days from date of original approval, provided, however, ±hat the storaqe of the vehicles shall not exceed the o*iginal 48 trailers, campers, or boats; and further provided, that if the number of vehicles =tored is increased to more than 48 vehicles, tnen all conditions of tlie aforementioned resolution shall be fully complied with immediately; and Fu:ther provided, that after the expiration of the 365th day, ramely November 16, 1970, if all the conditions have not yet been met, the storage operation shall cease and desist within ten (10) days ~rom expiration of said 365 days. j F ~ ~ 3. That compliance with the origirial conditions imposed by the Planning Commission are determined necessary for the peace, health, safety and general welfare of residents and property surrounding subject property as well as the citizens , of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby amend conditions of approval of Resolution No. PC69-235, dated November 17, 1969, granting Variance No. 213~: ny amending Condition No. 11, increasing the period in which to complete conditions from 90 days to 365 days, provided, however, that only 48 trailers/ campers~boats are stored on the property; BE IT FURTHER RESOLVED that if the petitioner intends to increase the nur~ber of vehicles above and beyund the 48 ~~ehicles now stored, all conditions shall be er.forced immediately; and that if upon expiration oi the 365 days the petitioner has not complied with conditions, said storage ooeration shall cease and desist within 10 days therefrom. BE IT FURTHER RE-50LVED that all conditions, includin9 the amendments as set foith above shall be restated witliin the body of the resolution for clarification purposes. (i) That all engineering requirements of the City of Anaheim along Lincoln Avenue, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as requi.red by the City Engineer and in accordance wi.th plans and specifications on file in the office of the City Engineer; and that a bond in an amount and form satisfactory to the City of Anaheim shall be qosted with the City to guarantee the installation of the above mentioned requirement. (2) That the owner of subject property shall pay to the Cii;y of Anaheim the sum of $2.00 per front foot alor.g Lincoln Avenue, for street ligliting purpuses. (3) That the owner of subject property shall pay to the City of Anaheim the sum of 15~ per front foot along Lincoln Avenue, for tree planting purposes. (4) That trash storage areas shall be provided in accordance with arproved plans on file with the office of tha Director of Public Woiks. (5) That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. (6) Drainage of subject property sha11 be disposed of in a manner that is satisfactory to the City Engineer. (7) That any parking area lighting proposed shall be dawn-lighting a maximum height of 6-feet, which lighting shall be directed away from the property lines to protect the residenti~l integrity of the area. (8) That tree screen landscaping shall be planted and maintained along the east, south, and west property lines of the trailer, camper, and boat storage area, adjacent to th? existing 6-foo.t masonry wall. {9) That drives and travelways shall be blacktopped, and that the area where travel trailers and boats are to be stored sha11 be treated with a sodium compound to eliminate the weeds and dust from affecting adjoining property owners. (10) That a sewerage dump s*ation shall be provided on subject property. (11) That Condition Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10, above mentioned, shall be complied wii:h within a period of 365 days from date of the originai resolution, namely November 17, 1969; provided that only 48 campers/trailers/boats are stored or. the property; that if more 48 vehicles are proposed to be stored said 365 day time limit shal] be come null and void and the petitioner shall comply with the aforementioned conditions immedi~tely; and further provided, that upon the expiration of said 365 days (November 16, 19'0), if the conditions have not been complied v.~ith, operation of the storage of vehiclas shall. cease and desist within 10 days of said expiration, and al] vehicles removed from the premises.
