PC 70-201RESOLUTION N0. p~0'201 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL OF~~HE C.~TY OF ANAHEIM THAT PETITION FOR RECLASSIFICATION N0. 71 BE DISAPPROVED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Re- classification from JOHN R. AND GEORGE W. EHRLE, 1568 North Bernice Drive, Brea, California 92621, Owners; INVESTORS DEVELOPMENT CORPORATION, 1345 North Grand, Santa Ana, California 92701, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Lot 15 of the Golden State Tract No. 2. ; and WHEREAS, the City Planning Commission did hold e public hearing et the City Hall in the City ot Aneheim on N ov. 16, 1970, at 2:00 o'clock P.M. notice of seid public hearing having been duly given as required by lew and in accordence with the provisions of the Maheim Municipal Code, Chepter 18.72, to heer end consider evidence for end against ssid proposed reclesaification end to investieate end meke find:nge and recommendetions in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in Its bo- helf, and efter due consideretion ot all evidence and reports offered et said hearing, does find and determine the following facts: 1. That the petitioner proposes a reclassification of the above described property from t6e R-A, Agricultural, Zone to the R-3, Multiple Family Residential, Zone. 2. That General Plan Amendment No. 121 was considered previously for the area in which subject property is located, wherei~i the Planning Commission recommended to the City Ceuncil that the land use policy for the northwe,t corner of State College Boulevard and Romneya Drive be changed from low density residential to medium ciensity. 3. That although the proposed reclassification is in conformance with said General Plan Amendment, the petitioner is not providing sufficient ame~ities and buffering devices as are deem2d necessary for the protection of the adjacent single family homes. 4. That in many instances in the past where multiple family uses have been pioposed adjacent to single family developments, the Planning Commi:sion has required either step-down or transitional zoning between these types of uses, or some other type of buffering techrique to protect the integrity of existiny single family areas; and that even after numerous attem~ts by the Planninq Commission to assist the applicants in resolvino these proLlems, the applicants have not submitted a plan ttiat is acceptable to the City or to the residents in close proximity. 5. That a plan which would have been considered acceptable by the Planning Commission ~r;as withdrawn by the developer on the basis that the lending agency cetermined the design was unacceptable for their purpose „ 6. That reclassification of subject property should be granted only upon submission of acceptabie development plans wherein undesirable conditions not conducive to a good living environment for the adjacent single family residents have been buffered within the project rather than placing the burden of buffering upc~n the adjacent single farnily homeowners. 7. That tliree persons appeared representing a consi~erable number of persons present in the Council Chamber, and five letters and a petition signed by 87 property o•,:ners were received, all in opposition to subject petition.
