'''s ~ '; , '+ WHEREAS, the City Planning Cominission of the City of Anaheim did rec~ive a verified Petition for Reclassifica- tionfrom VIOLET VAN DELDEN, htARGARET GREEN, AND H. H. HAASE, 230 Castle Circle, Orange, California 92668, Owners; BURGER KING, 2101 South Atlantic Avenue, Los Angeles, California 90022, qgent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as the West 243 fePt of the following described property. Commencing at a point 528.98 feet South of the Northwest corner of the South one-half of the Northwest one-quArter of the Northwest one-quarter of Section 12, in Township 4 South, Range 10 West, running.thence East at right angle to the West line of the Northwest one- quarter of the Northwest one-qt~arter of said Section 12, 579.71 feet to a point, thence Northeasterly in a direct line to a point 424.25 feet South of the Northeast corner of the South one-half of the Northwest one-quarter of ihe Northwest one-quarter oF said Section 12; thence North 88 feet to a point; thence West 1320 feet; more or less, to the West line of said Northwest one-quarter of the Northwest one-quarter of said Section 12; thence South along said line 192.73 feet to the point of beginning. ; and WHEREAS, the City Planning Commission did hold o public hearing at the City Hell in the City oE Aneheim on November 16~ 1970~ at 2:00 o'clock P.M. notice of sald public hearing having been duly given as required by law and in eccordence with the provisions of the Anaheim Municipn! Code, Chapter 18.72, to hear ond consider evidence Eor and ageinst seid proposed reclassification end to investigate and meke findings and recommendetions in connection therewith; end R'HEREAS, said Commission, after due inspection, investigetion, and stud,y mede by itself and in its behelf, and efter due consideration of all evidence and reports offered at said hearing, does find and determine the following fects: 1. That the petitioner proposes a reclessification of the above described property from the R-A, Agric~ltural, 2one to the C-1, General Commercial, Zone to establish an en~losed restaurant on subject property. ~ 2. That the proposed reclassification is in conformance with the Anahe;m Genaral Plan and with existing land uses in close proximity to subject property. ---~a 3. That the proposed reclassification of subject property is necessery and/or desirable for the orderly and pro- per development of the community. 4. Thet the proposed reclessification of subject property does properly relete to the zones and their ~ermitted uses locelly established in close proximity to subject praperty and to the zones end their permitted uses generally estab- lished throughout the community. 5. That the proposed reclassification of subject property requires the dedication of the abutting alley and the improvement of the aliey and the abt~tting street in accordanc.c- with the Circulation Element of the General Plan and requirement of the City Fngineer, due `.o the anticipated increase in traf.`•ic ~vhich will be generated by the intensification of land use. 6. That the petitioner stipulated to providing a landscape berm (approximately 2- feet in height) along the State College Boulevard frontage to assist in pa.rtially screening the parking area from view of the street. NO'N, TIiEREFORE, BE IT RESUL~'ED that the Anaheim City Planning Commission does hereby recommend to the City Council of the City of Anaheim that subject Petition foi Reclassification ; be approved, and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended ; to exclude the above described property from the R-A, Agricultural, Zone and to incorporate ; said described property into the G 1, General Commercial, Zone, upon the following conditions which are hereUy found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim. 1. That all engineering requirements of the City of Anaheim along State Coliege Boulevard, ~ including preparation of improvement plans and installation of all improvements, such as curbs ~ and gutters, sidewalks, street grading a~id Naving, drainage facilities, or o~her appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file with the City Enoineer; that street lighting facilities along State College Boulevard shall be installed as required by the Director of Public Utilities and in ~ accordance with standard plans and specifications on file with the office of the Director of Public Utilities; and that a bond in an amount and form satisFactory to the City of Anaheim shall , be posted with the City to guarantee the installation of the above mentioned requirements. 2. That the owners of subject property shall pay to the City of Anaheim the sum of 15¢ per front foot along State College Boulevard, for tree planting purposes. 3. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Direr,tor of Public Works. 4. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. -. 5. That a 6-foot masonry wall shall be constructed along,the east property line and that portion of the north property line which abuts R-1 zoned property. 6. That all air-conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent residential properties. 7. That an/ parking area lighting proposed shall be down-liqhtinq of a rtiaximum height of 6-feet, which lighting shall be directed away from ti~e property lines to protect the residential integrity of the area. 8. That subject property shall be served by underground utilities. 9. That drainage of subject property shall be disposed of in a manner satisfactory to ~he City Engineer. 10. That the standard 20-foot alley shall be dedicated and constructed across this parcel to Sta te College Boulevard, and the location of said alley shal! be approved by the City Engineer. - 11. That subject property shall be developed substantialiy in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, and 3, proviaed ~ however, that a landscaped berm shall be developed within the planting areas along the State ~ College Boulevard frontage. 12. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. 1 - and 2, above mentioned, shall be completed. The provisions or rights granteo by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 13. That Condition Nos. 3, 4, 5, 6, 7, 8, 9, 10, and 11, above mentioned, shall be complied with prior to final building and zoning inspections.
