A RESOLUTION OF TEiC CITY PLANNING COMMISSION OF THE CITY OF ANAHEIN
THAT PETITION FOR CONDITIONAL USE PERMIT 1210 BE DENIED
WHEREAS, the City Planning Commission of the City oE Anaheim did receive a verified Petition Eor Con-
ditionat Use Permit Erom PAUL B, TREAT, P. 0. Sox 7, Fullerton, California 92632, Owner;
JAMES K. SCHULER AND ASSOCIATES, 1095 North Main Street, Suite 5, Orange, California
92667, Agent of certain real property situated in the City of A;;ahei.m, County of Orange,
State of California, described in Exhibit "A" attached hereto and referred to herein as

WHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City of Anaheim
on December 14, 1970, at2 :00 o'clock P.NI., notice of said public heering having been duly given
as required by law end in accordance with the provisions otthe Anaheim Municipel code, Chapter 18.6q,to hesr
and consider evidence for and egainst said proposed conditionat use and to investigate and meke findings and
rFCOmmendations in connection therewith; and
ll'HEREAS, said Commission, after due incpection, investigation, and study made by itself and in its be-
half, and after due consideration of all evidence end reports offered at seid hearing, does find end determine the
following facts:
1. That the proposed use is properly one for which e Conditional Use Permit is outhorized by Cod~
Section 18.40,060(f) to establisli a G4-unit, two-story motel.
2. That subject peti[Lon is denied on [h:e basis that the projecc is an apartment
house rather than motel with all units having kitchens, and should be developed to
apartment parking, recreation and square Eootage standards.
3 That the proposed use will adversely aftect [he adjoining land uses and the
growth and development of the area in which Lc is proposed to be located.
4. That the granting of the cor.ditiona: use permit wlll be. detrimental [o the
peace, health, safety, and general welfare oE [he citizens of the City of Anaheim.
5. That thLs development sl~uld be in a residential zone.
6. That no one appeared in opposition.
