That waiver 1-a, above mentioned, is hereby waived on the basis that the areas concerned are to be used for either private patios or pedestrian access and sucf~ waive*s fiave been granted in the past. 6. That the requested variance is necessary for the preservation and enjoyment ot a substantial property right possessed by other property in ti~e same vicinity and zone, and denied to the property in question. 7. That the requested variance will not be materially detrimental to the public welfare or injurious to the property or improvements in sucn vicinity and zone in which the proF;erty is located. 8. That two persons appeared representin9 20 Persons present in the Council Ctiainber expressing concern that additional traffic into the substandard alley to tt~e west could create hazardous conditions which are complicated by many large trucks ~vnich use both t.he alleys and local streets to and from the industrial area northerly of subject prop~ar±y. NOW, TI~tRFFORC-, BE IT RESOLVED that the Anatieim City Planning Commission does liereby qrant subject Petition for Variance, upon the following conditions whicli are I~ereby found t.o b~ a necessary prerequisite to the proposed use of the subject property in ord~r to preseive tfie safety and general welfare of the Citizens of the City of Anaheim. 1. That the owner of subject property sha11 deed to the City of Anaheim a strip of land 10 feet in width from the centerline of the alley, for alley widening purposes. 2. That all engineering requirements of the City of Anaheim along Olive Street and the alley to the west of subject property, including preparation of improvement plans and in- stallai:ion of al] improvements such as curbs and gutters, sidewalks, street gradina and paving, including paving of ttie entire width of the alley asstipulated to by the petitior~ei; drainage facilities, or other appurtenant work shall be complied with as required by the City [ngineer and in accordance with standard plans and specifications on file in the office of the City Engineer; that street lighting facilities along Olive Street and La Palrna Avenu~ shall be installed as required by the Director of Public Utilities and in acco:dance with standard plans and specifications on file in the office of the Director of Public Uti;it.ies~ tf~;t a bond in an amount and form satisfactory to the City of Anaheim shall be ,r,osied v~iti~ the City to guarantee the installation of the above mentioned requirements. 3. That the owner of sub'?ct property shall pay to the City of Anaheim the sum of 15t per fronC foot along Olive Street and La Palma Avenue, for tree planting purposes. 4. Tree well locations shall be subject to the approval of the ParE:way Maintenance S~pelintendent. 5. That the sidewalks shall be installed along La Palma Avenue as required by thu Cily Engineer and in accordance with standard plans and specifications on file in the offic.e of th~ ~ity Engineer. 6. That trash storage areas shall be provided in accordance with approved plans on tilc~ with the office of the Director of Public Works. 7. That fire hydrants sha11 be installed as required and determineci to be necessary by cl~c ~,~~~r-f ot the Fi~e Department. 8. That suhject proparty shall be served by underground utilities. 9- That all air-conditioning facilities shall be properly shielded from view. 10. That any parking area lighting proposcd shall be down-lighting a maxirnum hei~l;t of 6•feet, wliich liqhting shall be directed away from the property lines to ~~rotect Li~e resi- dential integrity of the area. 11. Tf~at Condition Nos. 4, 5, 6, 7, 8, 9, and 10, above mentioned, shall be complied with prior to final building and zoning inspections. 1?. That Condition Nos. 1, 2, and 3, above rnentioned, shall be complied with nrior tu the comrnencement of the activity authorized under this resolution, or prior to tin. t.ime ll,at the building permit is issued, or within a period of 180 days from date herrof, wf~ichever occurs first, or such further time as the Planning Conmission or City Council rnay qrant. 13.
