PC70-49 1 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT 1158 BE DENIED ~ ~ WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Con- ditional Use Permit from DOUGLAS NORTOy, 1217 South Nutwood Street, Anaheim, California 92804,, Owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as beginning at the Northeast corner of said Lot 6, said Northeast corner being the intersection of the center line of the street 40.00 feet in width, now known as Nutwood Avenue, adjoining said Lot 6 on the East with the centerline of the street, 60 feet in width, now known as Bali Road, adjoining said Lot 6 on the North; thence Soutti- erly along the Easterly line of said lot, 250 feet; thence North 89° 40' Wesi; parallel with the North line of said lot, 200 feet; thence tJurth 1° 07' 40" East parallel ,vith the Easterly line of said lot, 250 feet to the center line of Ball Road; thence Easterly along the Northerly line of said lot, 200 Feet to the point of beginning; EXCEPTING TI'ERE-FROM that portion included in Fairview Avenue (now Ball Road) on the North and in Kellogg Road (now Nutwood Street) on the east as shown on said map. ; and WHEREAS, the City Plnnning Commission did hold a public hearing at the City Hall in the City of Anaheim on MarCh 23~ 1970~ at 200 o'ciock P.M., notice af said public hearing having been duly given as required by law and in eccordance with the provisions oEthe Anaheim Municipal code, Chapter 18.64,to hear and consider evidence for and egainst said proposed conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, seid Commission, eEter due inspection, investigetion, and study made by itselt and in its be- helf, and after due consideration of all evidence end repcrts offered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a Conditional Use Permit is authorized by Code; Section 18.40.0G0(e) to wit: establish a walk-up, drive-through restaurant on subject property. 2. That since reclassification proceedings for C-1 zoninq have been recommended for disapproval, the requested use would not be permitted or a;~propriate in the existing zor.e. 3. That the proposed use will adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 4. That the proposed use would be detrimental to the oeace, health, safety, and general welfare of the citizens in this area and of the City of Anatieims due to noises, odors, hours of operation, type of traffic which could create a hazard for the many children going to and from the four schools in the area, and ligh+ing which v~ould be affecting single family homes in close pro;cimity. 5. That three persons appeared representing 10 persons present in the Council Chamber, and a letter was received all in opposition; and that one person appeared and or.e letter was received in favor of subject petition. -1- ~ r~ NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby deny subject , Petition for Conditionel Use Permit on the basis of the aforementioned findings.
