A RESOLUTION OF ~CHE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2169 BE DENIED
WHEl2EAS, the City P1anning Commission of the City of Anaheim did receive a verified Petition for Variance from
KEN GEORGE DOI, 313 Ramona Court, Anaheim, California 92804, Owner; J. MC ADAMS9 9721
Mystic Lane, Anaheim, California 92804, Agent of ~ertain real property situated in the City
of Anaheim, County of Orange, State of Cali;ornia, described as the Easterly 125.00 feet,
measured parallel with the No=therly prolongation of the tangent portion of th~ Easterly
line of the Northerly 175.00 feet, measured parallel with the Easterly prolongation of the
tangent portion of the Northerly line of Lot i of Tract No. 4261, as shown on a inap re-
corded in Book 161, Pages 41 to 43 inclusive, of Miscellaneous ~daps records of said County,
including all of the improvements located thereon.
WHEREAS, the Clty Plonning Commieeion ddd hold a public heedng et the City Hell in the City of Aneheim on
March 233 1970~ et 2:00 o'clock P.M., notice of seid public heering hevtng been duly given as required by
law and in eccordance wIththe provisions of the Anaheim MunIcipal Code, Chepter 18.68, to heer and consider evidence for
end egainst aeid proposed varience and to inveatigete end meke findings and :ecommendetions in connection therewith;
and

'_ WHEREAS, seld Commiselon, eftet due inspection, Investlgetion, end study made by itself and in its behelf,
and efter due consideration of all nvidence and repocte otEered at seld heering, does find and determine the following
fecte:
1. That the petftioner requests e verience from tho Aneheim Municipel Code as follow5, to permit the
establishment of a motorcycle sales and service facility on subject property:
a. S ECTION 18.40.020 - Permitted uses in the C-1 Zone. (Motorcycle sales end
service facilities are pei•mitted only in the C-3 Zon=)e
b. SECTION 18.4~.020 - Permitted ou:door uses. (Outdoor display of motorcylces
~ is not permitted in the C-1 Zone.
I 2. That the use oroposed is too intense for the surrounding area, given the fact tnat
properties to the south are developed with residential uses, and noises emanatinq from
the proposed use would be deleterious to the residential environment.
3. That there are no exceptional or extraordinary circumstances or conditions appli~
• cable to the property involved or to the intended use of the property that do not apply
~ generally to the property or class of use in the same vicinity and zone.
4. That the requested variance is not necessary for the preservation and enjoyment of
~ a substantial property right possessed by other property in the same vicinity and zone,
I and denied to the property in question.
5. That the reouested variance wi:l be materially detrimental to the public Nelfare or
injurious to the property or improvements in such vicinity and zone in which the property
is located.
6. That one person appeared in opposition and two letters were received in opposition
to subject petition.
