That the grantinq of the Conditional Use Permit under the r.onditions imposed, if any, will not be detrimental to tne ~eace, health, safety, and general welfare of the citizens of the City of Anaheim. 8• That the petitioner stipulated that there would be no outdoor overnight storage of vehicles on subject property. 9. That one person appeared reyuesting that co;isideration be given to requiring landscaping in accordance with staff's recommendation; that no a~tomotive work be performed outdoors; that exhaust controls be installed to eliminate fumes, and paint or airborne particles contaminating adjoining properties, and that sound controls be provided to eliminate noises emanating from the body shop area. NOW, THEREFORE, BE IT RESOLUED that the Anaheim City Planning Commission ~oes hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject properi;y in order to preserve the safety and general welfare of the Citizens of the City ,:~f Anaheim. 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width on Broadway and 45 feet in width on Manchester Avenue including a 25 foot property line radius, for street widening purposea. 2. That the owners of subject property shall pay to tne City of Anaheim the sum of $2.00 per front foot along Manchester Avenue, for street lighting purposes. 3. That the owners of subject property shall pay to the City of P,naheim the sum of 15~ per front foot along ~anchester nvenue, for tree planting purposes. 4• That trash storage areas shall be pro~~ided in accordance with approved plans on file with the office of the Director of Public Works. 5. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 6. That all air-conditioning facilities shall be properly shielded from vie~v. 7. That subject property shall be served by underground utilities. 8. That adequate clearance of existing electrical lines shall be provided as re•- quired by the Electrical Division, Department of Public Utilities, and the State of California ~.0. 95. 9. That Condition No. 1, above mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of 180 days from date hereof, whichever occurs first, or such further time as the Planning Commissi.on or City Council may grant. 10. That Condition Nos. 2, 3, 4, g, ~~ 7, and 8, above mentioned, shall be complied with prior to final building and zoning inspections. 11. That subject property sha11 be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit vos. 1 and 2, provided, howiever, that landscaping shall be installed as depicted on Exhibit 1, inserted by staff and stipulated to by the petitioner; and further provided, that there sha!1 e no outdoor aiat~motive work performed, that exhaust controls be installed to eliminate p int fumes and paint or airborne particles from contaminating adjoining properties; an that sound controls be provided to eliminate noises emanating from the body shop area.
