PC70-62 } A RESOLUTION OF THE CITY PLANNING COMMISSION QF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT ~~~BE DENIED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition Eoc Con- ditional Use Permit from HERBERT GREEtJWALD, 1810 North Greenleaf Street, San±a Ana, California 927~6, Owner; RAYMOND SEE, 12726 Pellisier Road, lNhittier, California 90601, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Portion B: That ~ort:on of Lots 19 and 20 of Tract No. 59, Peralta Hills Tract No. 2, as shown on a map thereof filed in book 10 page 18 Miscelianeous Maps records of Orange County. Beginning at the intersection of the east line of said lots with the south J.ine of the right of way for Santa Ana Canyon Road; thence southerly along said easterly line 300.64 feet; thence at right angles to said easterly line westerly 184.00 feet; thence parallel with said easterly line northerly to the southerly line of the right of way for Santa Ar,a Canyon Road; thence along said southerly line to the point of beginning. ; and WHEREAS, the City Planning Commission did hold e public hearing et the City Hall in the City of Anaheim on Ap=il 20, 1970~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Maheim Municipal code, Chepter 1H.64, to hear and consider evidence for and against said proposed conditional use and to investigate end make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigetion, and study made by itself and in its be- half, and after due consideration of all evidence and reports ofEered at said heering, does find end de2ermine the following facts: 1. That the proposed use is properly one for which a Conditionel Use Permit is authorized by Code : Section 18.40.060(c) to wit: establish an automobile service station with waiver of: S[CTION 18.40.020(B-3) - Code requirement that service stations be located at the intersection of two hiahwa~, each designated as a primary or secondary highway. (Portion B only). 2. That since the reclassification proceedings for C-1 zoning have bePn recommended for disapproval, the requested use would not be permitted or appropriate in the existing zone. 3. That the proposed use will •~dversely affect the adjoining land uses and the growth and development of ciie area in which it is proposed to be located. 4. That the proposed use will be detrimental to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 5. That four persons appeared, representing 50 persons present in the Council Chamber all in opposition; that nine letters, 2 cards, and a petition signed by 134 persons, all residents of the Peralta I1ills, were i•eceived in opposition; and that onE person appeared and presented a petition signed by 1?_5 persons - residing north of Santa Ana Canyon Road - in f;.vor of subject petition.
