WHEREAS, the City Plepning Commiseion of the City of Anaheim did receive a vetified PetiUon for Con- Jitional (Jse Pmmit from VINCENT AND RUTH SULLIVAN, ROUTE 1, BOX 180, TEMPLETON, CALIFORNIA 93465, 6Vvner; ANTONIO H, RANGEL, 318 North Stardust Avenue, Placentia, California 92670, Agent of certain reai property situated in the City of Anaheim, County of Orange, State of California, described as Parcel 1: That portion of Lot 1, Block 6 of the Golden State Tract, as sho,vn un a map recorded in Book 4, Pages 66 and 67 of Niscellaneous Maps, Records of said Orange Co~~nty, shown as Parcel 2 on a map recorded in Book 1, page 38 of Parcel Maps records of sai~l Orange County. EXCEPTING THEREFROM the Southerly 130.00 feet of the Westerly 148.63 feet. ; and WNEREAS, the City Planning Commission did hold a public hearing at the City H~ll in the City of Anaheim on January 26, 197U at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by lew and in accordance with the provisions of the Meheim Municipal code, Ch:ipter 18.64, to hear and consider evidence for end against said proposed condi!'nnal use and to investigate and make findings and recommendations in connection therewith; end WHEP,EAS, said Commission, after due inspection, investigatlon, and study made by itself and in i:s be- half, and aEter due consideration oE ell evidence and teports offered et said hearing, does find and determine the following facts: 1. That the proposed use Is pooperly one for which e Conditional Use Permit is authorized by Ccde: Section 18.52.050(1-a) to wit: establish an M-2, Heavy Industrial, Zone use - out- door storage of heavy equipment - in the M-1, Light Industrial, Zone on subject property with waivers of: a. SECTION 18.52.060(3-b) - Enclosure of outdoor storaqe areas. (6-foot masonrv wall required; 6-foot chainlink fence proposed). b. SECTION 18.08.440(2) - The requi.rement that a lot have fronta4P on a public street or allev. ~ ~ i 2. 7'hat VJaiver 1-a, above mentioned, is hereby granted on the basis that the Planning Commission in the past has granted similar waivers, and that the petitioner stipulated to providing a six-foot wide screen landscaped strip adjacent to the G-foot high chainlink fence which would be erected along al' property lines of the property. 3. That Waiver 1-b, above mentioned, was withdrawn by the petitioner when he stipulated to providing a 20-foot wide strip of land fronting on Red Gum Street (future) to provide vehicular access for the proposed use, said 20-foot wide strip of land would be a part of the total parcel and ~~ould be so indicated by a parcel map. 4. That the petitioner stipulated to providing an asphalt surface for the entire parcel exclusive of the landscane area. 5. ?hat the proposed use, as approved, will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 6. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area r.or to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 7. That the granting of the Conditioh~t Use Permit under the cond_tions imposed, if any, will not be detrimental :o the peace, health, safety, and general welfare of the Citizens of the City of Ana~~~im. 8. That a letter was r:~eived from the property owner immediately to the north of subject property, in opposi~:on to the proposed chainlink fence, reqUesting ihat •~rov~sion be made for some screen landscaping and annual review of the proposed use. ~ • iT A~y ~ NOW, THEREFORE, SE IT RESOLVED thet the Anaheim City Plenning Commission does hereby grent subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessery pcerequisite to the proposed use of the subject property in order to preserve the sefety and general w~elfare of the Citizens of the City of Anaheim: 1. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 2. That fire hydrants shall be installed as required and determined to l-,e necessary by the ~hief of the Fire Department. 3. That all air-conditioning facilities shall be properly shielded from view. 4. That a parcel map to record the approved division of subject property be submitted to and approved by ttie City cf Anaheim and tlien be recorded in the office of the Orange County Recorder. Said parcel map shall indicate that subjec± property sha11 have a minimum of 20-feet of frontage on Red Gum Street. 5. That sut~ject proper~y shall be served by underground utilities. 6. That a 6-foot wide landscaping strip shall be provided together with irrigation faci- l~ties within th~ inside of the proposed 6-foet chainlink fence proposed along the perimeter of subject property, said landscaping shall consist of 15-gallon Canary Island Pines planted on 20-foot centers wiCh two 5-yallon Acacia Latafolia planted equidistant between the pines. Furthermore, said landscape strip shall be perpetually maintained in order that the outdoor storage may be adequately screened from adjoining properties; and that plans for said land- scaping shall be st~bmitted to and approved by the Superintendent of Parkway Maintenance. 7. That the enti:e area of subject property, with the exception of the required land- scaping areas, shall ne surfaced with asphalt as stipulated to by the petitioner. 8. That C;ondition Nos. 1, 2, 3, 4, 5, 6, and 7, above mentioned, shall be complied with prior to the commencement of ttie activity authorized under this resolution. 9. That subject property shall be developed substantizlly in accordance with plans and specifications on file with the City ~f Anaheim, mar'•ed Exhibit No. 1.
