PC 70-77RESOLUTIO. .;0 PC70-77 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT 1168 ~~ GRANTLD WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Con- ditionalUse Permitfrom CLIFECO, INCORPORATED, 886 West 16th Street, Newport Beach, California 92660, Owner; RALPH STOCKMAN, 1647 West Sepulveda Street, Torrance, California 90501, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described in Exhibit "F." attached hereto and referred to herein as though set forth in full. ?I ' ~~ * ~ ~.i ~ , ; and WHEREAS, the City Plenning Commissian did hold a public hearing et the City Hel! in the City of Anaheim on May 18 ~ 1970~ et 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear and consider evidence for and against said proposed conditional use and to investigate and meke findings and recommendetions in connection therewith; and WHEREAS, seid Commission, efter due inspection, investigation, and study mede by itself and in its be- half, and after due consideretion of all evidence and reports offered at said hearing, does Eind end determine the following fects: 1, That the proposed use is properly one for which a Conditional Use Permit is euthorir.ed by Code Sectien 18.40.060(g) to wit: establish on-sale beer and wine in a proposed restaurant, with waivers of: a. SF.CTION 18.62.090(B-1) - Number of free-standinq siqns. (1 permitted; 2 existing; 3 proposed). ~ b. SECTION 18.62.090 B-5 - Permitted siqn location. (Sign proposed adjacent to west property line; Code would require sign to be located in the center 20% of the property). 2. That the petitioner stipulated that only on-sale beer and vaine was proposed to be served in conjunction with the serving of food. 3. That the petitioner withdrew his request for sign waivers 1-a and 1-b, above mentioned, stating that he could achievesufficient identification of his restaurant with a wall sign. 4. That the petitioner stipulated to providing a 6-foot masonry wall along the north property line in the event the owner of the apartment development to the north desired same. 5. That the oetitioner stipulated that 25% of the floor area of the proposed restaurant would be devoted to food preparation and that final plans for a building ,' oermit would be revised to reflect this percentage. ; 6. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. ~' 7. That the size and shape of the site proposed for the use is adequate to allow ~ the full development of the proposed use in a manner not detrimental to the particular area ~ nor to the peace, health, safety, and general•welfare of the Citizens of the City of Anaheim. j 8. " ... ............... ... . ! ~ ~ , . ] NOW, THEREFORE, BE [T RESOLVED thet the Anaheim City Plenning Commission docs hereby grant subject Petition for Conditionel Use Permit, upon the following condit3ons which ere hereby found to be a necessery prerequisite to the proposed use of the subject property in ocder to preserve the safety and general welfare of the Citizens of the City of Aneheim: 1. That trash storage areas shall be provided in accordance v~ith approved plans or fiie with the ofr'ice of the Director of Public Works. 2. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 3. Tnat any air-~condition:ng facilities shall be properly shielded from view. 4. That any parking area lighting proposed shall be down-lighting of a maximum height of 6-feet, which lighting shall be directed away from the proper±y lines to protect the resi- dential integrity of the area. 5. That subject property shall be servec by underg2•ound utilities. 6. That any final parking plans =ha11 be approved by the Development Services Departmenty and any landscaped areas in the parking area shall be protected with 6-inch high concreie curbs, and concrete wheel stops shall be provided for parking spaces as required by the Development Services Department. 7. That ~ubject ~roperty shall be developed substantially in accordance with plans and specificatior.s on file with the City of Anaheim, marked Exhibit Nos. 1, 2, and 3, provided, however, that revised plans shall be submitted which shall indicate relocation of the restr:om facilities having access from the main dining room, rather than thru the bar-game room areas. 8. That a 6-foot masonry wall shall be provided along the north property line, i~ the event the cwner of the apaztment development to the north desires said wali. If said wall is not desired, then a certified letter so statir~g and signed by the property owner to the north shall be submitted to the Development Servi~es Department. 9.
