RICHARDSON, 1833 East 17th St*eet, Santa Ana, California 92701, Owner of certain real property situ~ted in the City of Anaheim, County of Orange, State of California, described in Exhibit "A attached hereto and referred to herein as though set forth in full. WEiEREAS, the City Planning Commieaian did hold a public hearing at the City Hell in the City of Anehelm on ~'~ June 2, 1970, at 7:00 o'clock P.M., notice oE seid public hearing heving been duly given es requiced by lww end ln uccatdance with the ptovisions of the Aneheim Munlcipal Code, Chepter 18.68, to heer and consider evidence for ~~ and ageinst soid proposed vorience end to inveetigete and make findings and recommendetions in connection therewith; _ , , end WHEREAS, said Commission, efter due inspection, investigeUon, end study mede by itself and in its behalf, and efter due eonsiderotion of all evidence and repoRs otEeced at seid hearing, does find and determine the following Eects: 1. Thet the petitioner requests e varience from the Aneheim Municipal Code as follows, to establish a 105-unit apartment complex: 1) SECTION 18.28.0~0(2) - Buildiny site area per dwellinq unit. (2400 s.~cuare feet per dwelling unit required; 1860 square feet proposeci). 2) SECTION 18.28.050(6-a-~~ - Minimuni required landscaped setback adjacent to a local street. (15 feet of landscaped setback required; 5 feet and 0 feet propused. 3) S ECTION 18.28.050(7) - Minimum distance between buildinqs. (Va* in distances required; insufficient distances between buildi.ngs proposed). s~ . F~ A !:~ ~ 2. That the petitioner presented no evidence to substantiate a hardshi~ existed iri the development of subject property to warrant the ~lanning Commission's favorable consideration. 3. That the proposed density !:!4 dwelling units per acre) is 30~; qreater than that permitted in the R-?_ Zone (18 dweiiing units per acre) and as such would present too great a bu*cien upon the single-family tiomeowners in the R-1 subdivision to the south. 4. That the size and shape of {.he property is adequate to develop the property within the confines of the site development standards of the R-2 Zone, thereby providing amenities more compatible wi.th the existing R-1 homes to the south. 5. That subject property does not have the same development problems as the property to ' the southeast, consequently there is no justification for considering the aforementioned ~ waivers as necessary for the proper development of the property.
