BENGOCHEA, 2582 Seville, Anaheim, California 92806, Owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Lot No. 57 of Trac,t No. 2167 ; and WHEREAS, the City Plf~nning Commission did hold a public hearing at the City Ha11 in the City of Anaheim on June 2, 1970, at 7:00 o'clock P.M., notice of said public hearing haviug been duly given as required by law and En accordance with the provisions oi the Anaheim Municipal Cade, Chapter 1E.68,to hear and consider evidence for and egainst said proposed variance and to investigate and make findings and recommendations in ~onnec- tion therewith; and 1VHEREAS, said Commissinn, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1, That the petitioner requests a variance from the Anaheim Municipal Code as fol~Ows, to construct an addition to an existing residential structure: SECTION 18.24.030(2) - Minimum side vard setback. (5 feet required; 4 feet proposed). 2. That there are exceptiona! or exttaordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally ta the prope:ty or class of use in the same vicinity and zone. 3. That the requested variance is necessary for the preservation and enjoyment of e substantial property right possesseu by other property in the same vicinity and zone, and denied to the property in question. 4. That the requested variance witl not be materially detrimental to the public welfate or injurious to the prop- erty or improvements in such vicinity and zone in which the propetty is located.
