3. Thet the requested variance is necessary for the preservation and enjoyrn~nt of a substential property right
possessed by other property in the some vicinity and zone, and denied to the property in question.
4. That the requested variance wil( not be materially detrimental to the public welfare or injurious to the prop-
erty or improvements in such vicinity and zone in whir.h the property is located.
5. That the petitioner stipulated to granting approval and obtaining approval of the
holders of the pipeline easement to be used for riding and hiking trails at such time in
the futurP as these trails may be de~veloped.
