WHEREAS, eaid Commission, aftor ~'ue inspection, investigation, and study made by itself and in its behelf,
and after due c:,naideration of all evidence ond reporta offered at seid hearing, doe~ Eind and deterr.~ine the following
factv:
1. That the petitioner cequeeta e variance from 4hr Anahelm Municipel Code:
a. 3ECTION 18.28.050(10-c) - Code re uicement that parkin~ b~e within 200
feet of the_unit ir serves. (68 units are
more than 200 feet from the covered parking
space) .
b. SECTION 18.28.050(10-d) - Waiver of Code reQuirement~ khat carports be
enclosed on three sides. (Approximately 60%
of the required carports are proposed to be
roofed only),
c. SECTION 18.28.050(10-d) - Waiver of stora~e cebinet location.

2. That the petitioner proposes to construct a 157-unil one and two-stur}• apartment
compl.ex on subject praperty.
3. That since the Planning Commission recommended denial of the reclassification of
subject p•operty, subject petition would no longer be valid and is therefore denLed.
4. T-~at there are no exceptional or extraordinary circumstances or conditions applicable
to the ;~roperr.y involved or to the intended use of the pr.operty that do nut apply generally
to the property or class of use in the same vicinity and zone.
5. That the requested variance is not necessary for the preservatioii and enjoyment of

and denied eo the property in question.
6, That the requested variance witl be materiaily detrimental tc, ~he public welfare
or injurioua to the property or improvements in such vicinity and zone izi which the property
is located.
7. That one person appeared representing ten persons present in lhe Council Chamber, all
in opposition; that a peL•ition signed by i02 persc+ns representing 59 single family homes
was received, also in opposition; and that a petitiori signed by eighr. persons was received
indicatir~g no opposition, provided cert.ain provisio ns tor protection of Lhe single family
homea adjacent to the subject property were provid ed.
