PC 72-103~ ~ RESOLUTION NO, PC72-103 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CiTY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2365 _ BE GRANTED WHEREAS, the City Planning Commission of the City oi Anaheim did receive a verified Petition for Variance Erom WILLIAM and SHIRLEY ALMAND, 3335 West lincoln Avenue, Anaheim, Califarnia 92801, Owners of certain land ait~eted in the State of California, County of Orange, City of Anaheim, in the Rancho Loa Coyotee, described as follows: The East 100 feet of the South 350 feet of the South half of the Southwest quarter of the Southweat quatter of Section 11, Tov~mship 4 South, Range 11 Weat S. B. B. & M, ; and WHF,REAS, the City Plenning Commisston did hold a publie heering et the City Hell in the City of Aneheim on Dfay 15, 197P, at 2:00 o'clock P.M., notice of seid public hearing heving been duly given es required by iaw end in eccordance with the provisians of the Anaheim Municipel Code, Chepter 18.68,to hear end consider evidence for and egainst said proposed veriance and to investigate and meke findings end recommendations in connec- tion therewith; and WHEREAS, seid Commissien, after due inspection, investigation, and study made by itself end in its behalf, end efter due consideration of all evidence end ceports offemd et said heering, does find snd detecmine the following facts: ' 1. That :he petitioner cequests e variance from the Aneheim Municipel Code as follows: SECTION 18.16,020 - Permit•ted use&. (Mobilehome unit proposed on rear of sinRle family parcel; mobilehome units permitted onZy fn mobilehome parlca) 2. Thet there ere exceptionel or extraordinery circumstances or conditions appliceble to the property involved or to the intended use of the pruperty that do not apply generally to the property or class of use in the seme vicinity and zone. 3. Thet the requested vorience is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the seme vicinity and zone, end denied to the property in question. 4. That the requested verience will not be meterially detrimentel to the public welfate or injurious to the pmp- erty or improvements in such vicinity and zone in which the property is located. 5. T6at the ~ae should be granted for a period of twelve (12) years except that if the property is sold, the variance shall become null and void, V1-G -1- ~ ~ NOW, THEREFORE, BE IT RESOLVED thet the Aneheim City Plenning Commisslon does hereby grant subject Petition for Variance, upon the Eolloariug conditlons vtihich are hereby found to be a necessary precequisite to the pm- ~~osed ase of the subject pmperty in order to preserve the sefety And general welfare of the Citizens af the City of Anaheim: (1) That the owner(s) of subject property shall pay to the City of Anaheim the sum of $2.00 pe~ front foot along Lincoln Avenue for street lighting purposea, (2) That the owner(s) of subject property shall pay to the City of Anaheim the sum of 15 cents per front foot along i.incoln Avenue for tree planting purposes. (3) That the aidewalks and driveways shall be installed ~:o::g Lincoln Avenue as required by the City Engineer and in accordance with staridard plans and specifications on file in the office of the Cil•y Engineer provided, however, that e bond in an amount and form sal•isfactory to the City of Anaheim shall be posted with the City to ~uarantee the inatallation of the above mentioned requirements. (4) That the applicant shall pay a water assessment fee as determined by the Director of Public Utilities prior to the issuance of a building permit, (5) That subject property shall be developed substantially in accordance with plans an~? specifications on file with the City of Anaheim marked Exhibit Nos, 1, 2, 3 and 4. (6) That Condition Nos. 1 and 2, above mentioned, ahall be complied with prior to tne commencement of the activity authorized under this resolution, or prior to the time that the building permit is iasued, or within a period of 180 days, whichever occiirs firat, or such further time as the Planning Commission may grant. (7) That the use of the property for a mobilehome shall be granted for a period of twelve yr_ers provided, however, that if the property is sold, this Variance shall become null and void.
