PC 72-104~ ~ RESOLUTION NO PC72-lOk A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2367 BE GRANTED WHEREAS, :he City Pianning Commission of the City o~ Anaheim did receive a verified Petition Eor Varience fcom SOUTHERN CALTFORNIA GAS COMPANY, Post Office Box 3249 Terminal Annex, Los Angeles, California 90051, Oimer; DONALD J. FEARS, A.I.A., 1477 South Manchester Avenue, Suite 360, Anaheim, California 92802, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, deacribed as the westerly 230 feet of Lot 5 in Block 5 of the Golden State Tract ats per map recorded in Book 4, Pagea 66 and 67 of Miscellaneoue Dfaps, in the offfce of the County Recorder of said county ; end WHEREAS, the City Plennir.g Commission did hold a public hearing et the City Hall in the City of Anaheim on May 15, 1972, at 2:00 o'clock P.M., notice of said public hearing heving been duly given es required by law and in accordance with the provisions of the Anaheim Municipel Code, Chapter 18.68,to hear and consider evidence for end egainst seid proposed varience and to investigate and make findings and recommendetions in connec- tion therekith; end WHEREAS, saId Commission, efter due inspection, investigation, and study mede by itself and in its behelf, end after due consideration of all evidence and repo:ts offered at snid hearing, does find end detecmine the fol;owing facts: 1. That the petitioner reauests e variance Erom the Aneheim Municipel Code as follows: SECTION 18.52.060(3-b} - Outdoor storafee area encloaure requirement. (6-foot high masonry wall required; chainlink fence, 8-feet high proposed) 2. That rhe Planning Commission has determined that the ma3or portion of the outdoor storage is the overnight parkine of trucks, vans and company vehi~les rather than storage of other equipment or parts. 3, That there are exceptional or extreordinary circumstances izr conditions epplicsble to the property invo:ved or to the intended use of the property that do not epply generelly to tha property or cless of use in the same vicinity and zone. 4. That the requested veriance is necessery for the preservation and enjoyment of e substential property right possessed by other property in the same vicinity and zone, end denied to the property in question. 5, Thet the requested verience will not be meterially detrimental to the public welfere or injurio~W~ to the pmp- erty or improvements in such vicinity and zone in which the property is loceted. 6. That the petitioner stipulated to providing an edditional 100 feet of landscaping along the east and west property linea ~outherly of LaJalla Street (approximately 216 feet total depth) ;. 1'hat the peCitioner sCipulated to filing a new variance if they determine additional atorase areas are needed other than those presently proposed, V1-G _i_ ~ ~ NOW, THEREFORE, BE IT RESOLVED L3et the AneheIm Cfty Planning Commisslon does heceby grant subject Petition for Varience, upon thz fcllowing conditions which axe hereby found to be e necessary prerequisite to the pro- posed use of the subject pr~perty in ~rder to preserve the suEety and genewl welEere of the Citizens of tl~e City af Ananeim: (1) That subject property shall be developed substantially in accordance with plans and specificationa ~n file with the City of Aneheim marked Exhibit Nos, ], 2 and 3 pcovided, however, that an additional 100 fE~t of landscaping shall be inatal?ed along the east and west property linea sautherly of LaJolla Street to provide additional screening mf the park- ing and storage area. (2) That Condition No. 1, above mentioned, sht,ll be complied with prior Co the co~ence- ment of the activity authorized under this resolution, or prior to the time that the bu3.lding permit is isaued, or within a period of 180 days, whichever occurs firat, or such further time as the °lanning Commiasion may grant.
