A RESOLUTION OF THE CITY PLANNiNG COMMiSSION OF THE CITY OF ANAHEAt
RECOMIAENDING TO THE CITY COUNCIL OF THE CITY OI' ANAHEIM THAT
PETITION FOR RECLASSIFfiCATION NO. ~1-72-46 BE DISAPPROVED
WHEREAS, the City Plenning Commission of the City ot Meheim did receive a verif!ed Petition Eor Re-
clessificatlon from PfA1'.GARETE L. NIQUETTE, 2224 South Spinnaker Street, Anaheim, California
92802, Owner of certain real properCy situated in the City of Aneheita, County of Orange,
StaCe of California, described as Those portions of the Southeast one-quarter of the
Southeast one-quarter of the Northweat one-querter of Section 26, Township 4 Saiith, Range
10 West, in the Rancho Sar. Juan Cajon de Santa Ana, as ahown on a Map thereof recorded in
Book 51, Page 10 of Miacellaneous Maps, recorde of uaid Orange County, California, des-
cribed as follows: Parcel No. 1: The Easterly 100.00 feet of the Westerly 302.00 feet
of the Southerly 160.00 feet thereof, Parcel No. 2: Beginning at the Northweat corner
of the land of Margaret L. Niquette, Westerly along the Weaterly prolongation af khe
North line of r.he land of Niquette, a distance of 16.68 feet to a point in the East line
of Spinnaker Street, as shown on a Map of Tract No. 301%, recorded in Book 138, Page 15
of Miscellaneoas Maps; thence Southeasterly and Southerly along the E;.st litte of said
Spinnaker Street to its point of intersection with the center line of Orangewood Avenue,
as shown on the Mep of said Tract No. 3017; thence Easterly along said center Line to C'+e
Southwest corner of the land of Niquette; thence Northerly along the West line of the l+,nd
of Niquette, 160 feet to the point of beginning

law and in eccordence with the provisions of the Meheim Municipel Code, Chepter 18.72, to hecr end consider
evidence for end agalnst seid proposed recleasiElcation and to investlgete endmeke Eindings endrecommendetions
in connection the~ ~wlth; and
WNEREAS, seid Commission, after due inspection, investIgetion, end study mede by itse:f end in its be-
helE, and efter due consideretion of ell evidence end reports offerect at seid hearing, does find end determine the
following fects:
1. That lhe petitlone: proposes a reclasslEicatlon of the ebove described property from the R-A, AGRICULTUI2A]~
ZONE to the R-3, MUI.TIPLE FAMILY RESIDENTIAL, ZONE.
2. '"hat the propoaed reclassification is in conformance witli the land use designa-
tion of the General Plan,
3. That the bpplicant is unwilling to continue this request in arder to revise the
plana to mure closel! meet code requirements.
4. That the propoaed deasity exceeds that obtained Uy adjacent R-3 zoned property
vherein Code requirements were met.
5. That although the Anaheim General Plan depicta medium densiCy for subject ptop-
erty, the Planning Coc:nnission is reluctant to recommend approval of the reclassification
requeat unlese the petitioner met the requiremente o[ L•he one-atory height limitation ad-
jacent to eingle family reaidenCial use and unlese there was an opportunity to review the
pla~s of development.
6. That the proposed reclaseification of subject property is not necessary for the
o:~erly and proper devalopment of the community.
7. That the proposed reclaesificetion of subject property does properly r~late to
the zonea and their permitted uaes locelly eatablished in cloae proximity to aubject
property and to the zonea and their permitted uses generally eatabliahed throughout the
coromunity,

NOW, THEREFORE, BE IT RESOLVED thet the Maheim City Plenning Commisslon does hereby recommend
to the City Council of the Ciry of Aneheim thet subject Petition for RecleseiEicatlon be denied on the basis of the
eforementioned findings.
