PC72-116 A FtESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF r1NAHEIM THAT PETITION FOR RECLASSIFICATION N0. ~1-72-51 gE APPROVED WHEREAS, the City Ptannir.g Commission of the City of Aneheim did recelve a verified Pctition for Reclessifica- tion from DONALD A. NIELSEN, ET AL, 1386 Laster Avenue, Anaheim, California 928~2, Owners; WOODY JOHNSON, 1605 North Spurgeon, Santa Ana, California 92701, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Beginning at a point on the South line of the Southwest quarter of the Southwest quarter of Section 8, Township 4 South, Rangc 10 Weat, San Bernardino Base and Dieridia.n at a point 392 fee~ West of the Southeast corner of the Southweat quarter of the Southweat quarter of said aection, and running thence West 168 feet along the said South line; thence North paral- lel to the East line o£ said Southwest quarter of the Southwest quarter, 654 feet; th~nce East parallel to the South line of said Southwest quarter of the Southwest quarter, 168 feet; thence South parallel to the East line of the said SouthwesC quarter of the Southweat quar- ter, fi54'feet~to the point of begiriring: EXCEPTING THEREFROM'the South 40 feeC''L•hereof in- cluded.wiEhin Lincoln Avenue ' ; and WHEREAS, the City Plenning Com~~ission did hold a public heuring at the City Hall in the City of Aneheim on May 31, 1972, at 2:00 o'clock P.M. notice of said public hesring having been duly given as required by law end in eccordence with the provisions of the Anaheim Muuicipal Code, Chapter 18.72, to hear end consider evidence for and ageinst snid proposed ceclnssification und to investigete and make findings and recommendations in connection therewith; end WHEREAS, s~id Commission, efter due inspection, investigation, and study made by itself and in its behelf, and eftcr due consideretion of ell evidence and reports offered et seid hearing, does find nnd determine the follawing fects: 1. That the petitioner proposes a reclassification of the ebove dasccibed property Erom the R-A, AGRICULTURAL, ZONE to the C-1, GENERAL COMMERCIAL, ZONE. 2, That the proposed recl+~asification is in conformance with the land use designations of the General Plan. 3. That the proposed reclassificetion of subject property is r,ecessary and/or desireble for the orderly and pro- per deveiopment of the community. 4. That the p:oposed reclassification oE subject property does properly relete to the zones and their permitted uses locally estaUlished in close proximity to subject propecty and to the zones end their permitted uses genecelly e;stab- lished througheut the community. R-A -1- NOW, THERF.FORE, BE IT RE~ED that the Anaheim City Plan~g Commission does hereby recommend to the City Council of the Ci.ty of Anaheim that subject Petition for Reclassifi- cation be approved and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the above described property from the R-A, AGRICULTURAL, 20NE and to in- corporate said described property into the C-1, GENERAL COrQSERCIAL, ZONE upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City o£ Anaheim: (i) That the owner(s) of subject property shall pay L•o the City of Anaheim the sum of $2.00 per front foot along Lincoln Avenue for street lighting purposes. (2) That the owner(s) of subject propprty shall pay to the City of Anaheim the sum of 15 cents per front foot along Lincoln Avenue for tree planting purposes. (3) That the sidewalks and driveways shall be installed along Linculn Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. (4) That trash storage areas shall be provided in accordsnce with approved plans on file w2th the office of the llirector of Public Works. (5) That fire hydrants shall be installed as required and determined to be necessary by the Chief of the rire Department. (6) That all air condi.tioning facilil•ies shall be properly shielded fram view and the sound buffered from adjaceat properties. (7) That any parking area lighting proposed shall be d~Ym-lighting of a maximum height of 8 feet within 120 feet of the surrounding R-1 property, whi~h lighting shal.l be directed away from the property lines to protect the residential integrity of the area. (S) 'Ttiat subject praperty shall be served by underground utilities. (9) That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. (10) That subject property shall be developed substantially in accordance with plans and specifications on file with the CiCy of Anaheim marked Exhibit Nos< 1, 2 and 3. (11) Prior ro the introduction of an ordinance rezoning subject psoperty, Condition Nos. 1 and 2, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof ~r such further time as the City Council may grant. (12) That Condition Nos. 3, 4, 5, 6, 7, 8, 9 and 10, above mentioned, shall be complied with prior to final building and zoning inapectiona.
