PC 72-118.~ RESOLUTION NO ~ PC72-118 ~ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIAt THAT PETITION FOR VARIANCE N0. 23~2 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Varience rom EDWIN E. KETTLER, 525 South [dest Street, Anaheim, California 92805, Owner of certain eal property situated in the City of Anaheim, County of Orange, State of California, des- ribed as Lot No, 24 of Tract No. 158 ; and WHEREAS, tht City Planning Commission did hold e public hearing at the City Hall in the City of Anaheim in Dlay 31, 1972, at 2:00 o'clock P.hl., notice of said public hearing having heen duly given es required ~y law and in accordance with the provisions of the Anaheim Nunicipal Code, Chapter 18.68,to hear and considet ;vidence fot and egainst seid proposed varinnce end to investigate end make findings end recommendations in connec- ion therewith; and WHEREAS, said Commission, after due inspection, investigation; and study made by itself and in its behalf, 3nd after due consideretion of all evidence and repotts offered at said hearing, does Eind and determine the following facts: 1. (2400 squarc feet required; 2012 square feet proposed) b. SECTION 18.28.050110-a) - Dtinimum off-strent parkin~. (6 atalls required; 4 pro- posed) c. SEC:'1'1liN 18.28.050(6-b-2)- Minimum side setbACk. (7.0 feet required; 5 feet pro- posed) 2. That the petitioner propoaes to conser~ict a duplex in addition to khe existing duplex ~n subject property, having tandem parking for Cwo of the six required parking spaces. 3•. That there are exceptionnl or extreordinery circumstances or conditions epplicable to the propecty involved or to the intended use of the property that do not apply generally to the property or class of use in the seme vicinity and zone. 4.. That the requested variance is necessery for the preservation and enjoyment of a substantial ptoperty right possessed by ather property in the Same vicenity end zone, end denied to the property in question. 5. That the requested varience wil; nct be meterially detrimentel to the public welfate or injurio~s to the pmp- erty or improvements in such vicinity and zone in which the property is located. 6. That the petitioner ;ti.gt~laced to designating the tandem parkin~ spacea for given units, since he would be managin~ Lhe four units and could so adviae any prospective tenants. 1-G -1- • NOW, THEREFORE, BE IT RES~VED that the Aneheim City Planning Comllfission does hereby grant subject ~ Petition for Varience, upon the following conditions which ere hereby found to be a necessary prerequisite to the pro- posed use of the subject property in order to preserve the saEety and gencral welfere of the Citizens oE the City of Anaheim: (1) That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public [dorks. (2) That all air conditioning facilities shall be properly shielded from view, and the sound b~iffered from adjacent properties. (3) That the owner(s) of subject property shall pay to the City of Anaheim the appro- priate Park and Recreation in-lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. (4) That subject property shall be developed substantially in accordance with plans and specifications on file with the City oE Anaheim marked Exhibit Nos. 1, 2 and 3. (5) That Condition Nos. 7., 2 and 4, above mentioned, shall be complied with prior to fi.nal building and zoning inspections.
