BE GRANTED WNEREAS, the City Planning Commission of the City of Aneheim ciid ceceive a verified Petition for Conditional Use PermitErom KATHERINE CASTLEMAN, 3672 Oakwocd Place, Riverside, California 92506, iJwner; LYLE ANDF.RSON, 2739 North Lincoln Avenue, Burbank, California 91504, Agent of cez'tain real property situated in the City of Anaheim, County of Orange, State of California, described ss The East 20U feet (measured to the center line of Magnolia Avenue) of the South 312 fe~et ,. the North 502 feet (measured to the center line of Broadway Avenue) of the Northeast :i~~rte-: of the Southeast quarter of the Northeast quarter of Section 13, in Township 4 South, i:.;r,ge 11 West, in the Rancho Los Coyotes, as per map recorded in book 51, page il, Mi.scellan- eous Maps, records ; and WHEREAS, the City Flanning Commission did hold a public hearing at the City Hall in the City oE Annheim on June 12, 1972, at 2:00 o'clock P.M., notice of said public hearing hacing been duly given as required by~ law and in accordence with the provisions of the Anaheim Municipal code, Chepter 18.64, to hear end consider evidence for and egair.st seid proposed conditional use and to investigate and make fi~dings and recommenda[ions in connection therewith; and WHEREAS, said Commission, efter due inspection, investigation, and study mede by itself and in its behelf, and after due consideretion of all evidence and reports offered at said hearing, does find and detennine the following facts: 1. Thet the pcoposed use is properly one for which a Conditional Use Permit is authorized by Code Sect-ion 18.40.060(g) to wit: establish on-aale beer and wine in conjunction with an existing restau- rant. 2. Thet the proposed ~se will not adversely affect the adjoining land uses and the growth and development of the area in which it is ~:reposed to be located. 3. That the size and shape oF the site proposed for the use is adequete to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfere oE the Citizens of the City oE Aneheim. 4. That. the granting of the Conditional Use Pecmit under the conditions imposed, if any, will not be detrimental to the peace, health, sa4ety, and general welfare of the Citizens of the City of Anaheim. 5. That the petitioner stipulated that there wauld be no bar and that the serving of beer and wine would be in conjunction with the serving of food. Cl-G ' 1' ~ ~ NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Planning Commission does hereby grant subJect Petition for Conditionel Use Permit, upon the Eollowing conditions whtch ere hereby found to be e necessery prerequisite to the proposed use of the subject property in ocder to preserve the sefety and general welfece of the Citlzens oE the City of Anah~im: (1) That street lighting facilities along Ro~aland Avenue shall be installed as required by tlie Direc~or of Public Utilitiea and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the in- stallation of the above mentioned requirement. (2) That no bar shall be provided in the suhject restaurant, and the serving of beer and wine shall be in conjunction with the serving of food only. (3) That subject property shaZl be developed subatantially in accordance with plans and specificationa on file with the City of Anaheim marked Exhibit Nos. L and 2. (4) That Conditio~i No. 1, above mentioned, shall Ue complied with prior to the coimnence- ment of the activity authorized under this resolution, or prior to the time that the building permit ie issued, or within a period of 180 days from the date hereof, whichever occurs first, or such furthe~ time as the Flanning Commission may grant.
