A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAAEIM
THAT PET'ITION FOR VARIANCE N0. 2386 BE GRANTED
1VHEREAS, ihe City Planning Commission of the City of Anaheim did receive a veriEied Petition for Variance
from V. L. and KATHRYNE K, DAUSER, 2880 West Ball Road; Anaheim, California 9z804, and
SHU YIN6 and MARGARET WONG, 56 Addington Road, Brookline, Massachusetts 02146, Owners;
THOMAS M. YEDOR, 1900 Avenue oF the Stars, Suite 1200, Los Angeles, California 90067;
Agent, of certain real property situated in the City of Anaheim, County of Orange, State
of California, described as the blest 3 acres of the North one-half of the Northeast
quarter of the Northwest quarter of Section 24, 7ownship 4 South, Range 11 West, San
Ber7ardino Base and Meridian, and the East 2 acres of the West 5 acres of the North one-
half of the Northeast quarter of the Northwest yuarter of Section 24, Township L South,
Range 1i West, S,B.B.M,
; and
WHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City of Anaheim
on Ju 1 y 10, 1972 at ~: 30 o'clock P.M., notice of said public hearing heving been duly given as required
by lsw and in eccordence with the pcovisions of the Anaheim Municipel Code, Chapter 18.68,to hear and cansider
evidence tor and egainst said proposed verience end to investigate end meke findings and recommendations in cannec-
tion therewith; and
WHEREAS, said Commission, efter due inspectinn, investigation, end study mede by itself nnd in its behel[,
and after due consideration of all evidence and reports offesed at seid hearing, does find and determine the following
facts:
1. Thatthepetitionerreauests variances from the•-Aria'heim Municipal Code as follows:
a. 5cC'iION 18.23.050(5-b) - Maximum building hei4ht within 150 feet of a sinqle-
familL residential zone. (One-storv permitted; two
stories proposed)
b. SECTIU?:_1~_y.0 G-a - Pti~imum distance between buildinqs. (Leet proposed,
10 feet required)
2. That t~ie petitioner proposes to establisn a one and two-story 11is-unit apartment
complex.
3. ThaL waive~ of the one story height limitation within 150 feet of a single family
residential zone is hereby granted for the southern boundary, on the basis that the City
of Stantun requires only a 75-foot setback to two-story multiple family units, and for the
northerly boundary on the basis that the large R-A parcel will develop in a manner other
thar, ingle family residential.
4.. 'fhet there are exceptionel or extcaordinary circumstences or conditions appliceble to the property involved
or to the intended use oE the property that do not epply generally to the property or class of use in the same vicinity
and zone.
5., Thet the requested veriance is necessary for the preservntion and enjoyment of e substar.tial property right
possessed by other property in the seme vicinity and zone, end denied to the property in question.
6.. That the requested variance will not be materielly detrimentel to the public welEete or injurious to the pmp-
erty or Emprovements in such vicinity end zone in which the propedy is loceted.

NOW, THEREFORE, BE IT REb~VED thet the Aneheim City Plenning Commission does hereby grant subject
Petition for Vc+r~ance, upon the following conditions which are hereby found to be a r.ecessary prerequisite to the pro-
posed use of tF.e subject pcoperty in ocder to preserve the saEety and general welface of the Citizens of the City of
Anaheim:
~, That this Variance is granted subject to the completion of Reclassification No.
72-73-4.
2. That subject property shall 6e developed substantially in accordance with plans and
specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3, 4, 5, and 6.
