TAN, 4100 West Commomiealth, Fullerton, CalLfornia 92633, Age•nt of certain real property situated in the City af Anaheim, County of Orange, State of California, described as Lot No. 22 of Tract No. 796 ; and WHEREAS,the CityPlanning Commission did hold e publlc hearing at the CityHall in the City of Aneheim on July 24, 1972 at 2:00 o'clock P.M., notice of said public hearing heving been duly givm as required by lew and in eccordence with the provisions of the .4neheim Municipal code, Chepter 18.64,to hear end consider evidence for and ageinst said pr~posed conditionel use and to investigate end meke findings and recommendetions in connection therewith; and WHEREAS, said Commission, ofter due inspection, investigation, and etudy made by itsell ond in its br hal[, and efter due constderation of all evidence end reporta otfered ~t s~ld heorin6, does find and determine the tollowing fects: 1. Thet the proposed use is properly one [or which e Conditional Uae Permit is authorized by Code SECTION 18.64.020(1-f) to wit: establish a priva~e achool in conjunctioa with a single family dwelling with acceaeory living quertera with waivers of: (a) SECTION 18,16.050(4-b) - Maximum structural height. (5 feet permitted; 10 feet proposed) (b) SECTION 18.04.090(2-a) - Side vard parking requirement. (No parking in the side yard permitted; parking in the aide yard proposed) 2. That Waiver 1-a, above mentioned, is hereby granted on the baeis that the peti- tioner is propoaing a one-atory classroom structure ten feet from the property lins while a two-story single family reaidei:tial structure would be permitted within ten feet of the property line automatically. 3. That Waiver 1-b, above mentioned, is hereby granted on the basis that the peti- tioner ig providing a circular drive and the patking proposed would not be a detriment to the adjoining property. 4. That the proposed use will nol adversely afLect the adjoining land uses and the growth and development of the area in which Lt Ie pcopoaed to be located. ~. That the petitionar etipulated tu a maximum of ten etudents enrol'l~ed at one time in the proposed private school. -1- • ~ NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequiaite to the proposed use of the subject pzoperty in order to preserve the safety ar,d general welfare of the Citizens of the City of Anaheim: (1) That the ovaer(s) of subject prooerty shall deed tu the City of Anaheim a strip of land 32 feet in width from the centec•linE of the s:reet along Orange Avenue for street widening purposes. (2) That all engineeri::g requirements of tt.e City of Anaheim along Orange Avenue, including preparotion of improvement p7.ane and installation of all improvements, such as curba and gutters, sidewalks, street grading and paving, drainage facilitiea, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specificatior:3 on file in the office of the City Engineer and that street lighting facilitiea along Orange ~venue ahell be installed as required Uy the Dir- ector of Public Utilities ard in accordance with staadard plans and apecificationa on file in the office of the Director oi PLblic Utilities and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted witt~ the City to guarantee lhe ir.stalla- tion of the above mentioned requirements. (3) Thet the owner(s) of subject property shell pay to the City of Anaheim the aum of 15 cents per front foot along Orange Avenue for tree planting purposes. (4) That traeh etorage arears ahell be provided in eccordance with approved plans on file with the office of the Director of Putlic Worko. (5) That fire hydrants shall be installed as required and determined to be neces- sary by the Ciiief of rhe Fire liepartmer.t. (6) That subject pruperty shell be served by underground utilities. (7) That a s3x-foot meaonry wall ehall be constructed along the eaet and south prop- erty line(s). (8) Thet eubject property shall be developed aubstantimlly in accordance with plans and epeeifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2. (9) That Condition Nos. 1, 2, and 3, above mentioned, ehall be complied with prior to the commencement of the activity authorized under this resolution or prior to the time thet the building permit is iasued or within e period of 180 daps from date hereof, which- ever occurs firet or such further time ae the Planning Commiseion may grant. (10) That Condition Nos. 4, 5, 6, 7 and 8, above mentioned, shall be complied with prior to final building and zaning ir.spectione.
