PC72-167 A RGSOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2398 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive e verified Petition Eor Veriance from GEORGE T. REEVE, in care of Washington Laboratories, Incorporated, Pier 66, Seattle, Washington 98121, Owner; WYN HOLMES, 802 South Wayfield, Orange, California 92666, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Beginning at a point in the center of the Santa Ana Valley Irrigation Company's ditch, at the Southeaet cornei of the tract of land first described in a deed from S. L. Stone and Louisa I. Stone, to August Lemke and Auguste Lemke, recorded in book 89, page 317, of Deede, records of Orange County, California, and running thence aleng the center of the Santa Ana Valley Irrigation Company's ditch South 55° West '2.40 chainsa thence South 62° 36' West still along the center of said ditch 2.657 chains; thence North 23 30" West 10.893 chains thence North 70° 25' Eaet 4.895 chains; thence South 23° 30' East along the East line of Lemke's land 9.503 chains to the point of beginning, containing 5.07 acrea of land. EXCEPT that portion deeded to the State of California, recorded June 1, 1966 in book 7947, page 177, Official Records ; end WHEREAS, the City Planning Commiss:on did hold a public hearing at the City Hall in the City of Anaheim on July 24, 1972, et 2:00 o'clock P.M., notice of said public hearing heving been duly given es required by law and in eccordance with the provisions of the Anaheim Municipel Code, Chepter 18.68, to hear end consider evidence for end against seid proposed veriance end to investigete and meke findings and recommendations in connec- tion therewith; end WHEREAS, seid Cammissinn, efter due inspec(ioc., investigetion, and study mede by itself and in its behelf, end aEter due consideratlon of all evidence end ceports offered at seid haering, does find and determine the following facts: i. Thet the petitioner reeuests variances from the Anaheim Municipal Code: (a) SECTION 18.08.550 (b) SECTION 18,04.090(1-b) (c) SECTION 18.24.030(4-a) Minimum lot width on cul-de-sac lots. (60 feet required; 49 to 54 feet proposed) Minirum front aetback. (15 feet sequired; 10 i.:et proposed) Minimum lot width. (70 feet required; 65 feet proposed) 2. Thet there are exceptionel or extraordinery circumstences or conditions applicable to the property involved or tu the intended use cf the property that do not apply generelly to the property or cless of use in the same vicinity and zone. 3. Thet the requested veriance is necessary for the preservation and enjoyment of a substantiel property right possessed 6y other pruperty in the seme vicinity and zone, and denied to the propeRy in question. 4. That the requested variance will not be materially detrimentel ta the public welfete or injurious to the prop- crty or improvemertts in such vicinity and zone in which the proper:y is loceted. 5. That the petitioner stipulated to working with staff in order to provide the buffering devices requi'red in the Subdivision Ordinance of the City of Anaheim ae revised for the Scenic Corridor. V1-G -1- i _ ~ ~ NOW, TH~REFORE, BE IT RESOLVED that the Aneheim City Planning Commission does hereby grant subject Petition for Variance, upon the following conditions which ere heceby found to be a necessary prerequisite to the pro- posed ase of the subjeot p:operty in order ;o presecve the sefety end genetel wclfere of the Citizens of the City of Aneheim: (1) That this Variance is granted subject to the completion of Reclassification No. 67-68-13. (2) That subject property ahcll be developed substantially in accordance with plans and specificationa on file with the City of Anaheim marked Exhibit Nos. 1 and 6.
