Anaheim did receive e verified Petition for Varience fxom LOR~t7 E. SMITH, P. O. Box 42, Silverado, California 92676, Owner of certain real property situated in the City o£ Anaheim, County of orange, State af Calitornia, described as Lots 13 and 14 of Tract No. 498, z.s pex map thereof r.ecorded in Book 19, pace 24 of Miscellaneous Maps, records of said c,ranqe County. EXCEPTING the South 50 fe~t of Lct 14 ; end WHEREAS, the City Plenning Commission did hold a public hearing nt the City Hall in the City oF Anaheim on February 7, 1972 at 2:00 o'clock P.M., notice of >eid publicheeringhevingbeen duly given es cequi:ed 6y law nnd in accordance with the provisions of the Anaheim hlunicipal Code, Cheptec 18.68,to hear end consider evidence for and egeinst said proposed vecience end to investigete end meke findings end recommendetions in connec- tion therewith; and WHEREAS, said Commissinn, eftec due inspection, investigetion, and study mede by itself and in its behelf, and after due consideretion of all evidence and reports offered et seid heering, does find and detennine the following fects: ~ 1. Thet tl:e petitionec recuests a verience from the Anehelm Municipal Code: SECTION 18.16.020 - Permitted Uaes -(Trailer, Camper, and Boat Storage Yards not permitted; trailer, camoer, and boat etorage propoaed) 2. Thet there are exceptional or extreordinery circumstences or conditions appliceble to the p:operty involved or to the intended use of the property that do not apply generelty to the property or class of use in the seme vicinity ond zone, 3. Thet the requested veriance is necessery fo: tha preservation end enjoyment of e substantial property right possessed by oeher property in the seme vicinity end zone, and denied to the ptcperty in question. 4. Thet the requested vacience will not be materially detrimentel to the public welfare or injucious to the prop- ecty or impi~vements in such vicinity and zone in which the property is loceted. 5. Th~t the petitioner atipulated to installation of chainlink fencing with slats. 6. That the petitioner atipulated to posting a bond to guarantee the installatiou of cnrb, gutter, and sidewalk at the tima th= remainder of the property is developed along Mountain View Avenue. 7. That no one appeared in opp-sition. V?-G -1- ~ ~ NO~J, THEREFORE, BE IT' RESOLV~D that rhe Anaheim City Planning Ccnunission does hereby grsnt subject Petition fur Variance, upon the following conditiuns which are hereby found to be a necessary pxerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citiz2ns of the City of Anaheim. (i) That all engineering requirements of the City uf AnaUeim along Mountain View P.~rer.ue, inci,uding preps.ation of improvement plans and installation of all improvements, such a;s curbs ar.d guttea:•s, sidewalks. street grading and paving, drainage facilities, or other ap- purtonant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in tne offica of the Ci.~y Engineer; an~ that a bond in an amount acid form satisfactory ta the. City of Anaheim shall be posted with the City to guar- antee the installat9.on oi che aboce mentioned requirements. (4) That [rash stora~e areas ahall be provided in ~ccordance with approved plans on file with the office of the Dir~ctor of Public Works. (5) That fire hydranta shall be instaZled as required and determined to be necessary by the Chief of the Pire Department. (6) That any exterior lighting stia'L1 bE: directed away from the sbutting proper.ty 1?nes to eliminate a nuisance for adjoining propertiE~s. (7) That subject propercy shall be ser•oed by underground utilities. (8) That drainage cf subject property shall be disposed of in a manner satisfactory to the City Engineer. (9) That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 tmd 2; provided, how- ever: (a) tbat a redwood slatted chainlink fence, six feet in height, surr.ound the subject property; (b) that landscaping in the form of 15 gallon trees of a variety set fortli in the tree listing of the Sc.enic Corridor 2one shall be planted at 20 foot intervals on the interior of the north, souch and west property lines and irrigation faci- lities shall be provided; (c) that a 25 fo~L- landscaped front setback be provided along Mountain View Avenue; and; (d) that a sewer dump station be provided for Che users of the proposed sL•orage facility. (10) That a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City until at least 50% of the properties on the west side of the street are developed to guarantee the installation of the sidewalk along Mountain View Avenue at that tiu~e. (11) That Condition Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10, above mentianed, shall be complied with prior to the commencement of the activity authori.zad ur~der this resolution, nr prior to the time thaC the building permit is issued, or within a period uf 180 days from dr.te hereof, whichever occurs first, or such further time as the Plenning Commission may grant.
