Except the Souther- ly 53.00 ieet thereof for atreet purposes (Ball Road) ; and WHEREAS, the City Planning Commi~sion did hold a public hearing at the City Hall in the City oE Anaheim on August 21, 1972 et 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in accrocdence with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear and consider evidence Eor and agair.st said proposed conditional use end to investigate and make findings and rec~mmendations in connection therewith; and WHEREAS, caid Commission, efter due inspection, investigetion, and study made by itself and in its behalE, and after due con~ideration of ell evidence and reports offered at said hearing, does find end determine the following Eacts: 1, Thet the proposed use is properly one for which a Conditionel Use Permit is authorized by Code Section' 18.40.060(g) to wit: establish on-sale beer and wine in conjunction with an existing restau- rant. 2. That the proposed use will not adversely eEfect. the adjoining land uses and the growth and developmenl uF the area in wt~ich it is proposed to be :ocated. 3. That the size and shape of the site proposed for the cse is edeque!? to pllnw tUe full development of :he pmposed use in a manner not detrimantal to the particular acea nor to the peace, health, safety, and general welfere of the Citizens of the City of Aneheim. 4. Thet the granting o~i the Conditional Use Pecmit under the c~nditions imposed, if any, will not be detrimental to the peece, health, safety, and general welfare of the Citizens of the City of Anaheim. 5. That the petitioner stipulated to serving beer and wine only and ttiat the hours of operation wo~ld be from 11:00 a.m. to 9:00 p.m. 6. That the petitioner stipulated there would be no bar and that the counter shown on the approved plan was for food service only and, further, thot the serving of wine ond beer would be in conjnnction with the sale of food only. 7, That no one appeared iu opposition. Cl-G ' 1' ~, - - ~~~~~ ~ ~ ~ NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Plenning Commission does hereby grent subject Petition for Conditional Use Permit, upon the Eollowing conditions which ere hereby found to be e necessary pcerequisite to the proposed use of the subject property in ocder to preserve the sefety and generel welfere oEthe Citizens ofthe City of Aneheim: (1) That subject property shall be developed substantially in conformance with plans and specif.ications on file with the City of Anaheim marked Exhibit Nos. 1, 2 and 3. (2) That oniy beer and wine shall be served and that the hours of operation shall be from 11:00 a.m. to 9:00 p.m, as stipulated to by the petiCioner. (3) That there shall bc no bar and that the counter shown on the approved plan shall be for food service only and, further, that the serving of beer and wine shall be in conjunc- tion with the serving of food only.
