P~~2'Z1 ~ A P.ESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITiONAL USE PERMIT 1288 BE DENIED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petitien for Con- ditionalUsePermitfrom A. L. AND M. E. RIST, 11621 Montecito, Los Alamitos, California 90720, Owners; DALE L. INGRAM, P. 0. 23ox 229, E1 Monte, California 91734, Agent, o£ certain real property situated i.n the City of Anaheim, County of Orange, State of California. described as the East 198.00 feet of the West 396.00 feet of the North 660.00 feet of that portion of the Northeast quarter of the Northeast quarter of Section 3, Tewnship 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as said section is shown on a map recor~led in Book 51 Page 10 of Miscellaneous Maps in tl:e office of the County Recorder of said county, lying easterly of the easterly line of the land conveyed to the California Central Railway Company by deeds recorded November 9, 1887, in Book 327 Page 220 and in Book 327, Page 221 of Deeds, Records of Los Angeles County, California ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Aneheim an February 7, 1972 , et 2:00 o'clock P.M., notice of seid public hearin;, having been duly given as required by law and in accordence with the provisions of the Aneheim Municipal code, Chapter 18.64, to hear and consider evidence [or and egainst said proposed conditional use end to investigate end make findings and recommendations in connec•tion thecewith; end WHEREAS, said t:ommission, efter due inspection, investigation, and study made by itself end in its be- halE, end aEter due considewtion of all evidence and reports offered et said heering, doec find and determine the following fects: 1. That the proposed use is properly one for which e Conditional Use Permit is euthorized by Code SecLian 18.64.Oi:i(2-c) to establish a 219 unit, three-story motel. 2. That altheugn the applicant is requesting pErmission to establish ~ motel at this location, experienc~ wi.th the same type of complex built by the same developer has demonstrated that the units are actualiy advertised and used as apartments and substandard apartments at that. The proposed units are substantially smaller than the minimum re- quired for apartments and the kitchen facilities are significantly smaller. Furthermore, the parking facilities are provided on a one-s~ace per unit basis rather than a 1.5 space per unit basis for apartments. 3. That the subject property is located in an industrial area and residential uses should not be permitted to intrude into the industrial areas. 4. 7.'hat the proposed use should not be considered as a motel catering to the industrial cummun:.ty because salesmen and industrialists would have no use far zhe kitchen faci].ities. 5. 7.'hat by representing this development as a motel a density of over 100 units per net acre is achieved whereas the maximum density permitted in the R-3 zone is only 36 units per net acre. 6. That the proposed use will advex~sely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. Cl-D " 1' ~ ~ ~ 7.
