Lot 16 of Tr2ct No. 2534, as per mep recorded in book 115 PAj~P.B LS and 15 of Miscellaneovs *t~ps, in the office of Che covn*_y recorder of said county WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on SepCember 18, 197~, at 2:00 o'clock p.m., notice of said public hearing having been duly ~ven as required by law and in accordance with the provisions af the Anaheim Municipal Code, Chapter 18.68,to hear and considerevidence forand xgainstsaid proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after duc inspecfion, investigation, and study made b;~ itselC and in its behalf, and •rPter due conside~ation oi all e~ridence and reports offered at said hearing, does fnd and determine the following facts: 1. That the petitioner requests variances from the Anatieim Municipal Code as follows : a, SECTION 18.37.040(B-1) - Maximum number of free-atanding siQns. (1, permitted; 3 proposed) b. SECTIUN 18.37.040(B-1) - Minimum distance between free-sta:dinQ si~na. (300 feet required; 13 feet proposed) c. SECTION 18.37.040(B-2) - rfinimum heit~ht of free-standinQ siQrs. (8 feet re.quired; 6.5 feet proposed) 2. That granting subject petition would be eatablishing an iindesirable precedent wherein every otner service station in Anaheim could request similar signing. 3. Thae the Planning Commission earlier in 1972 had denied a similar request with a finding that approval would eatabliah a precedent for mass signi.zg of other service stations throughout the City and no changes have occurred to warrant favorable considera- tion of L-his petition. 4. That there are no exceptional or extraordinary circumstances or conditions appli- cable to the property involved or to the intended use of the property that do not apply generally to the property or class of. use in the'same vicinity pnd zone. 5. That the requested variance is not necessary ~or the preservation and enjoyment of a substantial property right possessed by other property in the same eicinity and zone, and denied ro the property in quesrion. 6. That the requested variance will Ue meterially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the prop- erty ... '_c.~.:sted.
