A RESOLUTION OF THE CITY PL.',NNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR 'rARJANCE NO. 2440 BE GRANTED
WHEREAS, the City Planning C;ommission of the City of Anaheim did receive a verified Petition for Verience
from MR, J. V. SMITH, 1925 Robert Lane, Anaheim, California 92802, Owcier of certain real
property situated in the City of Anaheim, County of Orange, State of California, deacribed
as Lot 60 of Tract No. 3204 ~s per map recorded in book 97 pages 1, 2 and 3 of Miscellaneoua
Mapa, in the office of the county recorder of said county

WHEREAS, the City Plenning Commission did hold e public heering et the City Hall in the City of Aneheim
on October 2, 1972 at 2:00 o'clock P.M., notice of seid pubSic hearing having been du:~ given es requiied
by law and in eccordance with the pcovisions of the Aneheim Municipel Coae, Chepter 18.68,to hear and consl6er
evidence for and egeinet seid proposed variance end to investigate end meke Eindings end recommendations 1n connec-
tion therewith; a~d
WHEREAS, seid Commissi~n, aEter due inspection, investigetion, end study mede by itself end in Fts behelf,
and after due consideretion of all evidence end repods offered at seid hearing, does find and defermine the following
fects:
1. Thet the petitionr;r requests e variance from the Anaheim Munlcipal Code:
SECTION 18,12.030(1_a) - Minimum front vard. (25 feet required; 23 feet proposed)
2. Thet there ere exceptionel or extraordinery circumstences or conditions eppliceble to the property involved
or to the intended use of the property that do not epply generelly to the propert,y or class of uae in the same vicinity
end zone.
3. Thet the requested veriance is necessery for the preservation and enjoyment oE e substantfel property right
possessed by other property in the seme vicinity end zone, snd denied to the property in question.
4. That the requested varience will not be meterially detrimental to the public welfare or inJurious to the prop-
erty or improvements in such vicinity end zone in which the prop_Ky Is loceted.

NOW, THEREFORE, BE IT RESOLVED thet the Aneheim City Plenning Commission does l~ereby grant subject
Petition for Varience, upon the following condltions which ere heceby fouad to be a necessery precequisite to the pro-
posed ase of t5e subject property in order to preserve the sefety and generel welfare of the Citizenm of the City of
Aneheim:
(1) That subject property shall be developed subatantially in accordynce with plans
and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2 and 3.
