T,EE, F.T AL, Post Office Box 158, Downey, California 90241, Owners; r10BIL OIL COR?'ORATION, Su#.te 101, 9901 South Paramount Boulevard, Downey, California 90240, Agent of certain =eal prcpesty situated in the City of Anaheim, County of Orange, State of California, described as *.h~ west 230.00 feet of the south 188.00 feet of the north 254.00 feet of the northwest quarter of Section 18 Township 4 south, Range 10 west in the Rancho Los Coyotes as per map recurdEd in Book 51 Page 10 of Miscellaneous Maps, in the office of the County Recorder of said ca~inty. That the pcoposed use is properly oae for which a Conditional Use Pecmit is authorized 6y Code ,~~ wit: SECTTON 18.40.060(c) to establish an automobile service station withi: 75 feet of a residential structure in an R-A, Agricultural, Zone. 2, That the affected R-A ~:arcel is planned for commerc~al development, and the pruperties to the east and west are already zoned C-1. 3. Thet the pcoposed use will not edversely ~Efect. the edjoining lend uses and the growth and developnent of the area in uhich it is proposed to be located. 4, That the size and shape ot the site propcsed for the use is edequate to u11ow the full develoE •t o[ the pmposed use in e msnner not detrimen:al to the particular area nor to the peace, health, safety, and general .velfare of the Citizens of the City ot Anaheim. 5. Thet the Q,~enting of the Conditional Use Pecmit under the conditions imposed, if any, will not be detrimental to the peace, liealth, safety, and general welfare of the Citizens of the City of Anaheim. 6. That the applicant stipulated to the remova.l of the island message units as shown on the plans. 7. That no one appeared in opposition to ti2= petition. Cl-G ' 1" • f ~ ~ NOW, THEREFORE, BE IT RESOLVED that the ~naheim City Planning Ccmmission does herebp grant subject Petition for Conditional Use Permit upon the follow- ing conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject prcperty in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That street lighting facilities alonq Lincoln and Magnolia Avenues shall be installed as required by the Director of Public Otili*_.ies and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and form satis- fa.ctory to the City of Anaheim shall be posted with the City to guarantee the installation of the above mentioned requirements. 2. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 3. That a 6-foot masonry wall shall be constructed along the south and east property lines; provided, however, that the bluck wall shall not be required across the ea.st 30 feet of the south propei-ty line, if the property to the south is zoned C-1. 4. 'Phat u parcel map to record the approved division of subject property be submitted to and approved by the City of Anaheim and then be recorded in the office of the Orange County Recorder. 5. That subject property shall be served by underground utilities. 6. That subject property shall be developed substantially in accordance with adopted Service Station Minimum Site Development Standards. 7. That drainage of subject property shall be disposed of in a manner satisfac~ory to the City Engir~eer. 8. That snbject. property shall be developed sub~tantial~y in conformance with plans and specifications on file with the City of Anaheim marked ~xhibit vos. 1, 2, 3, and 4; prcvided, however, that proposed island message units be eliminated as sti.pulated to by the petiLioner. 9. That Con3ition Nos. 1 and 4, above mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of 180 days from date hereof, whichever occurs first, or such further time as tne Planning Commission mav grant. i 10. That Condition Nos. 2, 3, 5, 6, 7, and S, above meniioned, snall be complie3 with p:ior to finel building and zonf.ng inspections.
