GRANTED WH~REAS, the City Planning Commission of the City o: Maheim did receive a vecified Petition for Con- ditional Use Permit Erom ANAHEIM HILLS INCORPOI~P.TED AND TE}CACU VENTURES, INCORPORATED, 380 Anaheim Hills Road, Anaheim, Californi.a 92806, Owners of certain real property aitua- ted in tiie City of Anaheim, County of Urange, State of California, as described in Exhibit "A" attached hereto and referred to herein as though set forth in full ; end WHEREAS, the City Plenning Commission did hold e public hearing at tlie City Hell in the City oE Maheim on October 18, 1972, at 200 o'clock P.M., notice of said public hearing having been duly given as cequired by law and in accordence with the provisions of the Anaheim Municipel code, Chepter 18.64, to hear and cansider evidence for end against szid proposed conditionel u~e end to investigete and make findings and recommendations in connection therewith; end WHEREAS, seid Commission, after due inspection, investigation, and study mede by itself and in its br half, and atter due considecation of ell evidence and reports offered at sald heoring, does find and determine the following fects: 1. That the proposed use is properly onr for which a Conditional Use Permit is authorized by Code Section 18.28.040(1) to establieh a 252-unit planned residential development with waivers of: (a) SECTION 18.08.4~~ - Lot frontaQe. (Lot frontage must be on a dedicated street; proposed lots will not be fronting on a dedicated street) (b) SECTION 18.28.OS0(1-a) - Minimum buildinq aite area. (7200 equar2 feet re- quired; 2277 equare feet proposed) (c), SECTION 18.28.050(1-b) - Minimum buildint~ aite width. (70 feet required; 28 feet proposed) (d) SECTION 18.28.050(5-b) - Mnximum buildinR height within 150 feet of ~n R-A Zone. (One story required; two atories proposed) (e) SECTI9N 18.28.050(7-b) - Minimum distance between buildin~s. (25 feet required; 23 £eet proposed) 2. T:~at Waivers 1-a, 1-b, 1-c, 1-d, and 1-e, above mentioned, are hereby granted on the basis that these are waivers typically granted with planned residential developments. 3. That the proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it ia proposed to be located. 4. That the aize and shape of the site proposed for the use is adequaCe to allow the full development of the proposed use in a manner noC detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Ana- heim. 5. That the granting of the Conditional Use Perm3t under the conditions imposed, if any, will not be detrimental to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 6. That the petitioner stipulated that there would be no roof-mounted equipment auch as condensers for air-condiCioning units. 7. (2) That a finel t~act m~p of subject property shall be submitted to and approved by the City C~unci'a and then be recorded in the office of the Orange County Recorder. (3) That any propased covenants, conditions, end restrictions ehall be submitted to and approved by tne City Attorney's Office prior to City Council ap~proval of the final tract map and, further, that the approved covenants, conditione, and restrictione shall oe'recorded concurrently with the final tract map.
