PC72-261 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAIiEIM THAT PE'I'ITION FOR VARIANCE NO. 2403 BE DENIED WHEREAS, the City Planning Commission of lhe City of Anaheim did receive a veri~ed Petition for Variance from ORANGE COUNTY FLOOD CONTROL DISTRICT, Attention of C.R. Nelson, 400 Civic Center Drive, Santa Ana, California 92701, Owner; PACIFIC AMERICAN PROPERTIES, 1NCORPORATED, Attention of Bernard Perlin. 3670 Wilshire Boulevard, Los Angeles, California 90010, Agent of cer- tain real property situated in the City of Anaheim, CounCy of Crange, State of California, as describes in Exhibit "A" attached hereto and referred to herein as though set forth in full; and WHEREAS, the City Planning Commission did hold a public heuring at the City H~11 in thc City of Anaheim on October 30, 1972, at 2:00 o'clock p.m., notice of said publir. I}earing having becn duly given as required by law and ~n accordance with the pruvisions of the Maheim Municipal Code, Chapler 18.68, to hear and consider evidence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, invesdgation, and study madc by itseif and in its bchalf, and after duc consideration of all evidence and reports ofCered at said he.aring, does find and determine the following facts: 1. Thatthepetitioner:equests variances from Che Anahgim Municipal Code as follows: a. SECTION 18.40.070(3-a) - Maximum buildinS height. (5 feet and 29 feet permittec~.; 30 feet proposed) b. SECTTON 18.40.070(6-a) - Zone boundary wall. (6 foot high solid masonry wall required; no wall proposed) 2. That d+ie to the fact that the Planning Commission has recommended disapproval af cl~e reclaseifica,tion of auhjec¢ property, the variance request cannot be exercised in Che existing zone on the proQerty. 3. T:iat there are no exceptional ur er.traordinary circumscences ur condi~ions appli- cable tu the property involved or to the intended use of the property that do not apply generally to the property or clae3 of use iti the same vicini[y and zone. 4. That the requested variance is not necessary for Lhe preserva~ion and en}oyment of a substantial property right possessed by other property in the same vicinity and zor,c, and denied to Lhe property in question. 5. That the requested variance will be materiaily detrimental Co the public welfare or injurious to the Qroperty or improvements in such vicinity and zone in which the pcoperty is located.
