P~~2-283 • A RESOLUTION UF THE CITY PLANNING COMMISSION OF THfE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2453 BE DENIED WHEREAS, the City Planning Ccmmission of the City of Maheim did receive a verified Petition for Variance from INCOME EQUTTY LIMITED OR IN7ERNATIONAL 6, ID'CORPORATED, 901 Dover Drive, Suite 102, Newport Bgach, Californta 92660, Ow~ter; J f~ND S SIGN COMPANY, Attentlon of Heary Chuba, 7582 acacia Drive, Garden Grove, California 92641, Agent of certain real prop- erty situated in the City of Anaheim, County of Oraige, State of ~alifornia, as dea- cribed in Exhibit "A" attach~sd hereto and referred to herein as though set forth in full; and WHEREAS, the City Ylanning Commission did hold a public hearing at the City Hall in the City of Maheim on November 13, 1972, at 2:00 o'clock p.m., notice of said pablic hearing having been duly giv~n as required by law and in accordance with the'provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and codsider evidence for and against said proposed varience and to invesiigate and mslce findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports oFfered at said hearing, does find and determine the foliowing facts: 1. That the petitioner requests a variance :rom the Anaheim Municipal Code: SECTION 18.62.090(B-2) - Height of free star.dinq aigns. 25 feet permitted; 50-foot hlgh free-standing sign propoaed) 2, That approvnl oE subject petition would establiah an undeairable precedent wherein other commercial office uses established in close proximity and throughout the City would be entitled to requesting aimilar aigning. 3. That approval of the proposed aign height would not be a guarantee Chat the peti- tioner wauld be succesaful in atCracting additiunal motel trade from the xreeway since aimilar aigning in other parta oF the commercial recreation area and commercial zones nad not reaulted in additional motel trade. 4. That physical inspection of the property by the Planning Commisaion indicated that the existing aigning was adequate and was r~eadily visible to paseing automotile traffic. 5, That there are~no exceptional or extraordinary circumstances or conditiona appli- cable Co the property involved or to the intended uae of the property that do not apply generally to the property or clasa of uae in the same vicinity and zone. 6.
