PC 72-293~ RESOLOTION NO. PC72-Z~ RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM FINDING THAT THE PROPOSED ACQUISITION BY THE FLOOD CnNTROL DISTRICT OF THE COUNTY OF ORANGE ZS IN CONFORMANCE WITH THE ANAHEI~ GENERAL PLAN WHEREAS, the Orange County Flood Control District has indicated that its existing easement rights in a parcel owned by Mr. Raymand E. Spehar, located easterly of Imperial Highway and southerly of La Palma Avenue in the City of Anaheim, are not adequate for future widening modifications of the Santa Ana River and preservation of open space, and WHEREAS, the Orange County Flood Control District has indicated that it has acqiired prescziptive rights in a strip of land owned by Century Pro~erties Fund 71-3, which adjoins the Spehar parcel on the north, by rea- son of a levee constructed on the strip in 1938. The flood control district desires to formalize its ownership in this strip of land by acquiring fee in t.he strip for the future widening modificatians of the Santa Ana River and the preservation of open space, and WHEREAS, the Orange County Flood Control District proposes to acquire fee in the Spehar parcel and the strip of land owned by Century Properties Fund 71-3, and WHEREAS, the Government rode of the State of California, Section 65402, provides in pa:t thet a local agency such as the flood control district shall not aaquire real property nor dispose of any real property, not construct a public building or structure in any county or city, until the location, purpose and extent of such activity has been reported upon as to conformity with the adopted general plan applicable thereto; and WHEREAS, Section 21151 of zhe California Public Resources Code pro- vides in part that a local agency, such as the flood control district, shall make an environmental impact statement for any project which may have a significant effect upon the environment; and WAEREAS, the proposed acquisition of the flood control district has been revi.ewed by the Anaheim City Planning Commission within the context oE Section 21151 of the California Public Resources Code and Section 65402 of the California r,overnment Code. NOW, THEREFORE, BE IT RESOLVED, that the Anaheim City Planning Commission does hereby find that the proposed acquisition by the fload control distric~ is in conformance with the City's adopted General Plan and will have no significant effect on the environment.
