71R-016 RESOLU11ION NO. 71R-16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF M~AHEIM FINDING &qn DETERMINING THAT TITLE 18 OF THE M~AHEIM MUNICIP_~ CODE RELATING TO ZONING SHOULD BE fu~END~D &~D THAT THE BOUNDA- RIES OF CERTAIN ZOI~ES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 70.-71-17 to consider an axnendment to rritle 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearin~ did receive evidence and reports from persons interested therein and from its staff; and - WHEHEAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findinSfs f a sUlillnary of the evidence presented at said hearing, and a reco~nendation that the proposed ai11endment be adopted by the City Council and th.at a certain zone or zones be ci~anged as hereinafter set forth, and -~'II-IEH.EAS:, upon receipt of said resolution, sununary of evidence! report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 8th day of Decernber~ 1970,. as the time, and continued to January 12, 1971 and Janu- ary 19, 1971, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of ~~e Anahein Municipal Code: and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorpora- tion thereof in tile zone or zones hereinafter set forth~ and did give notice -thereof in t.:.~e rnanner and form as provided in said iI'i tIe 18 of the l\na.t'lein: i-lunicipal Code~' and ~IERBASr at toe time and place fixed for said public :nearing the City Council did hold and conduct such public hear':- ing and aid give all persons interested therein an opportunity to be heard, and did receive evidence and reportsr and did ~~ere- upon consider the summary of evidence presented at said pUblic :nearing before ti1e Planning Comr..1ission.. its report of findings and recommendation, and WHElillAS, the City Council does find and determine that tlle amendment to Title IS of the Anaheim Municipal Code should De adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE I~ ~SOLVED by the City Council of the City of Anaheim that Title 18 of the AnaheiIn Municipal Code be, and the same is hereby: amended and that the following des- cribed property! situated in the City of Anaheim, County of Orange 1 State of California~ to wit~ iJ:'lle dorth 859.96 feet imeasured along the west line. of tl1e west half of the northwest quarter of the southwest quarter of Section 13, Township 4 South~ Range 11 West, in the Rancho Los Coyotes, County of Orange~ State of California, as per map recorded in Book 51, page 11 of Miscellaneous tlapsr in the Office of ~~e County Recorder of said County. --1- 70-71-17 be excluded from C-l, GENERAL CO~~RCIAL ZONE, and incorporated in R-3, MULTIPLE-FM~ILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a 25-foot radius property line return at Beach Boulevard and Orange Avenue, for street widening purposes. 2. That all engineering requirements of the City of Anaheim along Beach Boulevard and Orange Avenue, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurten- ant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifi- cations on file in the Office of the City Engineer; that street lighting facilities shall be installed as required by the Director of Public Utilities along Beach Boulevard and Orange Avenue, and in accordance with standard plans and specifications on file in the Office of the Di.rector of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above mentioned requirements. 3. That the vehicular access rights, except at approved access points, to Orange Avenue, shall be dedicated to the City of Anaheim; and that vehicular access to Be.ach Boulevard shall be as approved by the California Division of Highways. 4. That the owner of subject property shall pay to the City of Anaheim the sum of l5~ per front foot along Beach Boulevard and Orange Avenue for tree planting purposes. 5. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works. 6. lrhat fire hy.drants shall he installed as required and determined to be necessary by the Chief of the Fire Department. 7 · That a 6.-foot masonry wall shall be. constructed along the east property line. 8. That all air-conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent residential areas. 9. That subject property sh.all be served by under- ground utilities. 10. That the owner of subject property shall pay to the City of Anaheim appropriate fees, as established by the City Council, for park and recreation purposes, said fees to be paid at the time the building permit is issued. 11. The Developer be required to participate in the necessary drainage to the extent of 16.6% of the cost of the storm drain in Beach Boulevard, from Orange Avenue northerly to the Carbon Creek Channel, including catch basins and appurtenances. --2- -' .,~:_..._. _......... ....:............. .. .~:~.:.a..-.._..~.~-....-....,---...-.. ~.. ...~............... 12. That any parking area lighting proposed shall be down-lighting of a maximum height of 6-feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area. 13. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. 1 and 2 shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within 180 days. 14. That a 20-foot wide planting strip shall be pro- vided along the easterly boundary of subject property, and said planting strip shall be densely landscaped with live plant materials including IS-gallon trees planted on 10- foot centers adjacent to the required 6-foot masonry wall along the east property line; plans for said landscaping to be submitted to and approved by the Development Services Department. 15. That in order to provide for adequate emergency vehicular circulation to carports located near the north- west section of the proposed development, a minimum of 6 dwelling units shall be deleted from the project and an adequate vehicular circulation system, acceptable to the Fire Chief, shall be provided. 16. That the completion of these reclassification proceedings is contingent upon the granting and completion of Variance No. 2215. 17. That Conditions Nos. 3, 4, 5, 6, 7, 8, 9, 11, 12, 14, 15, and 16, above mentioned, shall be complied with prior to final building and zoning inspection. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, au~orized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
