That ther.e are exceptional or extraordinary circumstances or conditiona applicable to the property involved or to the intended uae of the property that do not apply generally to the groperty or class of use in the same vicinity and zone. 6. That the requested variance ie neceaeary for the preaervation and enjoyment of a substantial property right poesessed by other property in the seme vicinity and zone, and denied to the property in question. 7, That the requeeted variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commiseion does hereby grant in part eubject Petition for Variance, upon the followtng conditiane which are hereby found to be a necessery prerequiaite to the proposed uee of the subject pYOperty in order to preserve the eafety and general welfare of the Citizene of the City of Anaheim: (1) That eubject property ahall be developed subatantially in canformeace with plana and apecificatione on file with the City of Anaheim marked Exhibit No. 1 provided, however, that the portaL•le free-standing e!gns shall be eliminated as stipulated by the petitioner~ and thaC the only additional aign that will be permitted is the lighter box eign under the canopy.
