PC 72-322~ :..- ~ ~ RESOLUTION NO. p ~2'322 A RESOI.UTION OF THE CITY P).ANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE NO. 2460 BE GRANTED WHEREAS, the City Planning Cemmission oF the City of Anaheim did receive a verified Petition for Vacience f:om JAMES D. AND SANDRA J, MULL, 215 South Gain Street, Anahein, California 92804, Owners nf certsin real property situated in the City of Anaheim, County of Orange, State of Cali- fornia, described as Lot 7 of Tract No. 6691, as per map recorded in Book 250, Pages 20 and 21 of Miscellaneous Maps, in the office of the county recorder of said county, ; end WHEREAS, the City Planning Commissicn did hold e public heering et the City Hall in the City of Anahelm on December 11, 197'l, et 2:00 o'clock P.M., notice of seid public hearing having been duly given es required by lew and in eccordance with the pcovisions of the Aneheim Municipal Code, Chapter 18.68,to hear end conelder evidence for end egainst seid proposed veriance and to investigete and make findings end recommendations in cunnec- tion therewiih; and WHEREAS, seid Commissinn, after due inspection, investigation, and study made by itself end in its behelf, and efter due coasideretion of all evidence end :epods offered et seid hearing, does find and determine the following facts: • ' 1. Thet the petitioner requests a veriance from the Anaheim Municipal Code as follows: SECTION 18.2&.050(3) - Meximum lot coverage (35% lot coverage permitted; 44.8% lot coverage proposed) 2. That the petitioner proposes to construct a 384 square-foot room addition to the rear of the existing residence for a family room. 3. Thet fhere ere exceptional or extreordinary circumstences or conditions appliceble to the property involved or to the intended use of the property that do not apply generelly to the property or class of use in the same vicinity end zone. 4. Thet the requested varience is necessery for the pceservation end enjoyment of a substentiel property right possessed by other property in the seme vicinity end zone, and denied to the propedq in question. 5. That the requeZted variance will not be meterlally detrimental to the public welfare or injudous to the prop erty or impcovemants in such vicinity end zone in which the pcopedy is loceted. ENVIRONMENTAL IMPACT REPORT FTiVDING: That the Planning Cormnission finds and determines that the proposal would have no significant environmental impact and, therefore, ~:ecommends to ehe City Council that Exemption Declaration status be granted. V 1-G -1- r NOW, THEREFORE, BE IT RE~LVED thet the Aneheim City Plnnning Co~mm~sslon does hereby grant sut~ect PeUtion foc Varience, upon the following conditions which ere heceby found to be e necessary prerequI~ite to the pro- posed use of the subject property in order to pmserve the safety end general welfare of the Citizens of ~he City of Ananeim: (1) That subject property shall be developed siibstantially in ccnformance with plans snd specifications on file with the City af Anaheim naarked Exhibit No. 1 provided, however, the addition shall be architecturally compatiJ~la with the existing dwelling and that the roof of the addition shall be gabled to blend in with,the existing roof, and that roofing m•aterials shall match the existing roofing material.
