BONKOSKY, Trustee, 600 Weat Lincol[t Avenue, Anaheim, California 92805, Owner; BEACON BAY ENTERPRISES, INCORPORATED,. Z50 Newport Center Drive, Newport Beach, California 92660, Agent of certain real.property situated in the City of Anaheim, County of Orange, Stare of California, described as The South- erly 190.0 feet as measured at right anglea from the South line of the West half of the Northwest quarter of the Northwest quarter of the Nocthwest quarter of Section ~ 16, To~tnship << South, Range 10 West, as shown on a Map thereof recorded in Bonk 51, page 10, Miacellaneaus Maps, records of said Orange County; said land being further described ae Che Southerly i90.0 feet, as measured at righC angles from the South line of the West half of Lot 4 of Helen and Lynch°s Addition to Anaheim, as shown on a map thereof recorded in Book 442, page 188, Deeds, records of Los Angeles County, California , ; and WHEREAS, the City Plenning Commission did hold a public hearing et the City Hell in the City of Meheim . n December 11, 1972, et 2:00 o'clock P.M., notice of seid public hearing having been duly given 8$ cequired by law end in accordence wlth the provisions of the Aneheim Municipel code, Chepter 18.64,to heac and consider evidence for end egeinst said proposed conditional use end to investigate end meke findings and recommendatlon~ in connection therewith; and WHEREAS, seid Commission, after due inspection, invesdgetion, and study mede by itself end xn its br helf, end after due considcretion of eIl evidence end repods offered et sald hearing, does find and determine the following fects: 1. Thet the proposed use is properly one for which e Condttional Use Permit is authorized by Code Section 18,64.020(3-g) to wit: establiah a carwe~sh; and Section 18.40.060(g): establish an automobile service station within 75 feet of a residential zone with waivera of: a. SECTION 18.40.040 - Permitted outdoor usea. To permit outdoor wax- ing, polishing and detailing of automobiles. b, SECTION 18.40.020(b) (3) - Permitted location of service station limited to the interaection of two arteriel hiRhwava. 2, That the praposed use would not be located at the interseation •of two arterials and would have an impact by injecting very heavy traffi:a loads into a residential atreet as well as at a"T" intersection cresting many traffic hazards. 3. That ber.ause of the .extremely heavy traffic on the arterial, vehiclea exiting the proposed use on thie property would be subjected to insutmountable traffic problema, particularly when attempting to make left turns into traffic from the premiaea. 4. That although the petitioner was awa:e of the fact that the City of Anaheim had specific limitatior.s an sound emiasion by equipment, the decibal readinge this use would produce as atated by the petitioner, would exceed this resding and no evidence was pre- aented that said noises cGUld be mitigated to protect the restdential uaes to the eaat, 5. That representatives of the adjoining commercial facilities expressed very aerious concern that the proposed use would be detrin~ental to the existing commercial usea estab- lished in the area. 6. That the proposed use will adversely a£fect the adjoining land uses and the growth and development of the area in which it ia prop~oaed to be located. CI-D " 1" ~ ~ ~ 7. That the proposed use would be detrimental to the particular area and ~o the peace, heaith, safety, and general welfare of the Citizens of the City of Anaheim. 8. That four persons appeared, representing five persons present ir, the Council Chamber, in opposition to the proposed use. NOW, THEREFORE, HE IT RESOLVED that the Acaheim City Plenaing Commiasion does heceby dmy subject Petition for Conditional Use Pe~it on the basis of the aforementloned findings.
