PC72-329 ~ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM ' THAT PETITION FOR CONDITIONAL USE PERMIT 1359 BEGRANTED WHEREAS, 4he City Planning Commission of the City of Meheim did ceceive a verified Petition for Con- ditional Uce Permit from LEO FREEDMAN, 2346 Kerwood, Apartment 4, West Los Angeles, Cali- fornia 90064, O~aner of certain real ~roperty situated in the City of Anaheim, County of Orange, State of California, as described in Exhibit "A",attached hereto and re- ferred to herein as though aet forth in full ; end WHEREAS, the City Planning Commission did hold s public hearing et the C1ty Hall in the City of P~aheim on December 27, 1972 et 2:00 o'clock P.M., notice oE said public heacing having been duly given as cequired by law and in eccordance with tha pcovisions oE the Meheim Municlpel code, Chepter 18.64,to hear and consider evidence for end ageinst said pmposed conditionel uae and to investigete and make findings and recommen~iations In connection therewith; end WHEREAS, seid Commissiou, efter due inspection, invesUgetton, and etudy mede by itself end in its bc half, and after due conaidecation of ell evidence and reports offered et said heacing, does Eind end determine the following facts: 1. That the proposed use is properly one for which a Conditional Use Permtt is authorized by Code Section 18,37,030(C-3) to wit: establiah a ten-story hotel tower, approximately Y06,5 feet in height with waiver of: SECTION 18.37.030(E) - Minimum number of required parkin~ spaces. (511 s_paces proposed; 679 spacea required - a deficit of 168 apeces or 25%) 2. That the requirement of a sprinkler system for thia high rise tower is deemed necessary on the basis that the 1973 Uniform Building Code would require it and a build- ing permit could not be is~ued prior to the inception of said 1973 requirement; further- more, upon verbal evider.ce presented by the Chief af the Anaheim Fire Department that potential fires in tower structurea were difficult to control adeyuately; said sprinkler system would be vitsl for the safety of gueata in the tower. 3. That the petitioner stipulated tb relocation of the existing 21 palm trees to another location on the property. 4. I.~"f~~ ~ ~ 7, That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anahe4.m, 8. That the grsnting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, heeTth, safety, and general welfare.o•f the Citizeris'of'the.City of Anaheim. ENVIRONMENTAL IMPACT REPORT FINDING: That the City Council on December 19, 1972,,determined that an exemption status should be granted on the basis that the environmental impact would be trivial given the similar nature of developments in the i~nediate vicinity. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commiseion does hereby grant subject Petition for Conditional Use Permit, upon the following condi~ions which are hereby found to be a necessary prerequisite to the proposed use of the sub= ject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: (1) That this Conditional Use Permit is granted subject to the completion of Reclassification No. 66-67-61, now pending, (2) That the sidewalks shall be installed along Freedman Way as requ~.red by the Ci,ty Engineer and in'accordance with standard plans and specifications o~t file in the office of the City Engineer. (3) That the owner(s) of subject property shall pay to the C3ty of Anaheim the sum of 15 cents per front foot along Harbor Boulevard and Freedman Way for tree pYant- in~ purposes. (4) That street lighting facilities along Harbor Boulevard and'Freedman Way shall be installed as required by the Director of Public Utilitiea and in accordance with atandard plans and specifications on file in thP office of the Director of Public Utili- ties; and that a bond in an amount and form satiafactory to the City of Anaheim sha11 be posted with the City to guarantee the installation of the above mentioned requirements. (5) That trash atorage areas shall be pXovided in accordance with approved plana on file with the office of the Director of Public Works. , (6) That fire hydrants shall be installed and charged as required acid determined to be necessary by the Chief of the Fire Department prior to coaunencement of structural framing. (7) That all air conditicning facilities ahall be properly shielded from view, and the sound buffered from adjacent propertiea. (S) That aubject property shall be served by underground utilitiea. (9) That drainage of aubject property shall be dispoaed of in a manner that is satisfacCory to the City Engineer. (10) That the propused hotel tower ahall be equipped with an automatic sprinkler syatem and/or such other internal fire protection features as the Fire Department may require. (11) That subject property shall be developed substantially in accordance with plans and specifications on file with the City af Anaheim marked Exhibit Nos, 1, 2, 3, 4, 5, and 6. (12) That Condition Nos. 1, 3, and 4, above mentioned, ehall be complied with prior to the cormnencement of the activity authorized under thls resolution or prior to the time that the building permit is iasued or within a period of one year from the date hereof, whichever ~ccura first or such further time aR the Planning Commiasion may grent.
