PC72_339 ~ _ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE C1TY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2430 BE GRANTED IN PART WHEREAS, the City Planning Co:nmission of the City of Maheim did receive a verified PeGtion for Vaziance from UNION OIL COMPANY, 461 South Boylston, Los Angeles, California 90017, Owner; ARNE C, BELSBY, Mini Warehouse Corporation, 5600 Orange~horpe, No, 704, La Palma, California 90620, Agent of certain real,propetty situated.in the City of Anaheim, County of Orange, State of California, desEribed;as Beginning at the Southeast corner of Lot 1 of Frac- tional Section 5, Township 4 Sout!i, Raege 9 West, of the San Bernardino Meridian, accord- ing to an Official Plat of said land filed in the District Land Office, March 23, 1875; thence Westerly along the South line of said Lot 1, a diatance of 440.38 feet to the true point of beginning; thence continuing Westerly along the South line'of said Lot 1, a dis- tance of 37~.84 feet to the intersection with the Easterly line of the right of way of the Atchison, Topeka and Santa Fe Railroad; thence Northeasterly along the Easterly line of said Railroad right of way, a distance of 44.62 feet; thence Southeasterly in a direct line to the true point of beginning, excepting therefrom the Southerly 20 f.eet lying with- in the present right of way of La Palma Avenue; and WHER~AS, the City Planning Commission dld hold a• public hearing at the City Hall in the City of Maheirn on December 27, 1972, ~ at 2:00 o'clock p.m., notice of said public hearing having been duly given as reguired by law and in accordance with the'provisions of th0'Aneheim Municipal Code, Chapter 18.68, to hear and consider evidence f'or and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, suid Commissior., after due inspP.tion, investigation, and study made by itself and in its behalf, and after due consideration o1' all evidence and reports offered at said hearing, does find and determine t:ie following facts: 1. That the petitioner requests variancea. from the. Anaheim Municipal Code a6 fcllows to e'stab- lish 23 one-story "mini-warehouae" buildings: a. SECTION 18.52.060(2-a) - Minimum structural setback; (Permit a 6-foot high masonry wall to be located within the required 50 foot setback adjacent to a public street;(10 feet fxom the property line propoaed). (Reviaed plans ~ conform to setback requirementa; therefore, this waiver is not.applicable.j b, SECTION 18.52,060(4-a) - Minimum number of required parkinq spaceA. (S1 perking spaces required at 1/1000 square foot G.F,A.; 41 spacea proposed) 2, That the petttioner withdrew request for Waiver 1-a, abovP mentioned, upon sub- mission of revised plans which reflected compliance with the required setback in the M-1 Zone. 3. That Weiver 1-b, above mentioned, is hereby granted on the basis that the Cype of use proposed would require less parking than regulation warehouse facilitiea. 4. That there are exceptional or extraordinary circumstancea or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or clasa of use in the eame vicinity and zone. 5. That the petitioner stipulated to providing decorative masonry for both the facing of the building and the wall proposed. 8, That,tk~e petitioneY stipulated to landscaping comparable to that'on I~a Palma Avenue for the Tustin Avenue frontage," ''' ' • ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commiseion, on December ll, 1972. in Resolution No.•PC72-320, recoffinended to the City Council that ~nvironmental Impacr Report No. 61,filed in conjunction with Vari- ance No. 2430,be considered trivial and no Enviornmental.Impact Statement need be made, NOW, THEREFORE, BE IT RESOLVET~ that the Anaheim City Planning Commission doea hereby grant in'part 'sabjO~t~Pebition for Variance,,upon the following conditions which are here- by found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: (1) That all engineering requirem~nts of the City of Anaheim along La Palma and Tustin Avenuea, including preparation of improvement plans and installation of all im- provements, such as curbs and guttara, aidewalks, atreet grading and paving, drainage facilitiea, or other app~irtenant work, ahall be complied with as required by the Cit; Engineer and in accordance with atandard plana and specifications on file in the office of the City Engineer; that street lighting facilitiea along La Palma and Tuctin Avenuer. shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specificatione on file in the office of the Director of Public Utili- ties; and that a bond in an amount and form satisfactory to the City of Anaheim ahell be poated with the City to guarantee the installation of the above mentioned requirements, (2) That trash atorage areas shall be provided in Eccordance with approved plans on file with the office of the Directot of. Public Works. (3) That fire hydrants shall be instelled as required and determined to be neces- sary by the Chief of the Fire Depertment. (4) That subject property shall be served by underground utilities. (5) That drainage of subject property shall be disposed of in a manner that is sat- isfactory to the City Engineer. (6) That appropriake water assessment fees ahall be paid prior to the issuance of a building permit, (7) That the propoaed,apartment unit for security guards or caretakers shall con- form to City of Anaheim R-3 apartmeat stendarde and ahall be subject to approval by the Development Services Department. (8) That subject property ahall be developed eubatantially in accordance with plans and specificatione on file with the City of An~~~~ig ~p~r~~~~F~xl~~$i~ui~g~n ~v~~~~~sion No. 1), 2, 3, and 4.provided, hawever, that the walls/s a p 5e o ecorat ve masonry material and landacaping along Tustin Avenue shall be comparable to that proposed for La Palma Avenue, as stipulated to by the petitioner. (9) That Condition No, 1, above mentioned, shall be complied with prior to the com- mencement of the activity authorized under this resolution, or pr.ior to the time that the building permit ia issued, or within a period of one year from date hereof, rahichever occurs firat, or such further time as the Planning Commission may grant, ' (10) That Condition Nos. 2, 3, 4, 5, 7, and 8, above mentioned, shall be complied with prior to final building and zoning inspectiona.
