PC 72-332-- __ _ RESOL ~ N N0. PC72-332 ~ A RESOLUTION OF THE C1TY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION EOR VARIANCE N0. Z451 gE DENIED WHEREAS, the City Pianninq Commission of the City of Maheim did receive a verified Petition for Variance from ANAHEIM HILLS INCORPORATED AND TEXACO VENTURES, INCORPORATED, 380 Anaheim Hills Road, Anaheim, California 92806, Ownera of certain real property sit+iated in the City of Anaheim, County of Ofange, State of California, as described in Exhibit "A" attathed hereto and referred to herein as though set forth in full; and WHEREAS, the City Planning Commission did hold a pubtic hearing at the City Hall in the City of Maheim on December 27, 1972, at 2:00, o'clock p.m.; notiee of said public hearing having been duly given as required by law and in accordance with the'provisions of the Maheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against said praposed variance and to investigate and make findings aad recommendations in connection therewith; and WHEREAS, said Commission, ~~er due inspectton, investlgatlon, and study mede by ilself and in its bxhelf, end after duc consideration of all evidence and reports offered at said hearing, dces find and determine the following facts: 1. That the petitioner requeats r the ~ follmiing~~vari'lrices, from~ the Anaheim Municipal Code Eo permi.t the establiahment of a 184 lot subdivieion - R-1: a. SECTION 18.04.075 - Requir2ment that residential lots rear on arCerial hiqhways, (Side-on lote requeated) b. SECTION 18.24.030(4-a) - Minimum lot width, (70 feet required; lota having ~ 7 ns han 70 feer proposed) c. SECTION 18.08.550 - Minimum width of cul-de-eac lots, (60 feet on a tangene line drawn at the middle point of the aet- back radiua required; minimum of 37 feet propoaed) d, SECTION 18.24.030(4-b) - Minimum lot area. (7200 equare feet required; 24 lota ranging from 6000 to 7100 aquare feet propoaed) 2, That although the Planning Commisaion requested that the developer request a fer- ther continuance to reviae the kract map redesigning Lot Nos. 1, 17, and. 18 to reflect the minimum 40-fooC building aetback required by the subdivLeion ordinance, and redeaign Lot N~s, 143, 144, and 145, which were propoaed ta be served by an easement; the deve].oper was unwil,ling to cooperate and requeated that the Commission take action without any further. continuance. 3. That the petitioner~s unwillingneas to cooperate cauaed grave concern to the Plan- ning Commisaion that fukure development of Anaheim Hills would be conl•rary to denaities approved in the General Plan, which would conflict with eatablished development standards; and that the living environment for said area would be less than desirable. 4. That the density proposed woul~d be too great, and exiAting street patterns would be inadequate to handle this increased density. That the proposed easement lots, elthough designated as "view lots", would be extremelq~ difficult to maintain, since one lot wou7.d be bisected by a road creating a public thorough-;+;;%:' fare on private property which the property awner of said lot would be required to maintain. ,'. 6, That several lots were proposed to side on to an arterial street, thereby creating the possibility of conversion of these lote for coaunercial use in the future, based on requests that the Commiesion has faced in the past fn similar situations elsewhere in the City.
