A RESOLUTION OF THE CITY PLANNINC COMMISSION OF 7HE C1TY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 2463 BE GRANTED
WHEREAS, the City Planning CommissIon of the City of Aneheim dld receive e vedtied 'Petition for Vadence
Erom HAROLD AND NELEN THORPE, 1055 North ~rbor Boulevard, Anaheim, California 92801, Ownere
of certain reel property situated in the City of Anaheim, County of Orange, State of Cali-
fornia, deacribed as Lot No. 35 in Tract No. 1326

WHEREAS, the City Plenning Commission did hold a public heedng at the City Hall in the C!ty oE Aneheim
on December 27, 1972, at 2:00 o'clock P.M., notiee oE seid public hearing heving been duly givm as required
by lew end in eccordance with the provisions oE the Meheim Municipel Code, Caepter 18.68,to hear and consider
evidence tor end egainst aeid proposed variance and to inveatigete and meke findings and reeommendations in eonnec-
tio : therewith; and
WHEREAS, said Commiesi~n, efter due inapection, inveaHgatlon, end study made by itaelE and in its behalf,
and atter due consideretfon of ell evidenca and reports ofEered at said heedng, doee find and detertntnethe following

1. That the petitioner requests e varience [rom the Maheim Municipel Code.ee folloqe:
SECTION 18.40.050 - Limited commercial uae of a reeidential atructute, (To
permit the sale of pet supplies in conjunction with dog

2. Thet there ere exceptional or extxeordinary circumstences or conditions applicable to the property involved
or to the lntended use oE the pmperty thet do not apply generelly to the propeety or class of use in the eame vlctnit~•

3. That the requested varfance is naceasary for the preservadon and enjoyment of a substantlal propeety dght
posseased by other property in the srnne rlcinity and zone, end denied ta the propedy in question.
4. That the requeeted varlencc wlll not be matedally detrlmmtal to the pubiic wetfare or injurious to the pmp~
erty or improvemmta jn such v-cinity and zome in which the property is located.
5. Ttiat the petitioner stipuLated thaC there would be no kennels, dog runs or the
boarding of doge on the premiaea; that the houra of operation would be from B a.m. to 4 p.m.i
and that the;_parking-epacee would be opeq to customers ,from 8.a.m, to 4-p.m.•only,~aince tihe
dog grooming and incidental retail eales of pet supplies would be by appointment only.

EPTVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Co~ission finde and determinea that the propoeal wou2d heve no aignificant
environmental impact and, therefore, recommende to the City Council that Exemption Declaration
Statua be granted.

NOW, THEREFORE, BE IT P.ESOLVED thet the Aneheim Clty Plenning Commission does hereby grant subject
Petition for Variance, upon the following conditions mhich ere heceby found to be a necessary pcerequisite to the pm-
posed use of the subject property in ordec to pcesecve the sefety and general welfere of the CitYzens of the City of
Anaheim: '
(1) That the owner(s) of subject property shall pay to the City of Anaheim the sum of
15 cents per front foot along Harbor Boulevard for Cree plantins purposes.
(2) That the owner(s) of eubject property shall pay to the City of Anaheim the sum of
$2,00 per front foot along Harbor Boulevard and Victor Avenue for street lighting purposes.
(3) That the existing structure shall be brought up to the minimum standards of the
City of Anaheim, including the Uniform Buiiding, Plumbing, Electrical, Housing, Mechanical
and Fire Codes as adopted by the City of Anaheim.
(4) That all signs shall conform with the provisions of the Anaheim Sign Ordinance,
and all existing non-conforming and/or i3legal,signa shall be remuved from the site.
(5) That Condition Nos, 1, 2, 3 and 4, above mentioned, shall be complied with within
45 days from the date of'thia resolution.
(6) That there shall be no kennels, dog runs, or boarding of dogs on the premises; and
that the hours of operation shall be from 8 a.m. to 4 p.m. as stipulated to by the petitioner.
THE FOREGOING RESOLUTION ia signed end epproved by me thia 4th day of January, 1973.
