BE GRANTED WHEREAS, the City Planning Commission of the City of Aneheim did recelve a verified Petition for Conditional Use Pecmitfrom PAULINE E. HINRICKS, 300 North State College Boulevard, Anaheim, California 92806, Owner; GEORGE S, HANOSH, 300 North State Coliege Boulevard; Anaheim, California 92806, Agent of certain real property situated in the City of'Anaheim, County of Orange, State of California, described as Lots 15, 16, 17, 18 and 19 in Block 3 of Santa Fe Tract, as shawn on a map thereof recorded in book 21, page 49, Miacellaneous, Records of Los Angeles County, California ; and WHEREAS, the Clty, Planning Commission did hold a public hearing at the City Hall in the Clty of Anaheim on December 27, 1972~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in accordence with the provisions oE the Aneheim Municipal code, Chapter 18.64, to hear end consider evidence for and ageir.st seid proposed conditionel use and to investigete and make findings and recommendetions in connectton therewith; and WHEREAS, seid Commission, efter due inspecUon, investigation, and study made by itself and in its behalf, and atter due considecation of all evidence end ceports ofEered et said heering, does find end detecmine the following facts: 1. That the proppsed use is properly one for which e Conditional Use Pecmit is authocized by COde Section' 1P.;40.060(j) to wit: establiah an auto rental-leasing agency in an exiating commercial building with waiver of: SECT.ION 18.40.070(4-a-2-£) - Minimum number of required parkinA spacea, (28 saaces required; 16-18 spsces propoaed) 2, That waiver of the required parking spaces,is herEby granted on the basis that the petitioner proposes to lease vehicles by contract agreement and the propesed parking ~aould be ad2quate for use proposed. 3, T1iat the proposed use will not adversely effect. the adjoining land uses end the growth end development of the erea in which It is proposed to be located. 4. That the size and shepe of the site proposed fnr the use Is adequete to allow the full development of the pmposed use in a manner not detrimentel to the partlculer erea nor to the peace, health, sefety, and general welfare of the Citi,zens of the City of Anaheim. 5. Thet the granting of the Conditionel Use Pem~it under the conditions imposed, if any, will not be detrimental to the peace, health, safety, end ge~erel welfare of the Cltizens of the City of Anahei.^.i. 6. That the petitioner stipulated there would be no retail sales of vehicles unlesa these were a part of the lease agreement. 7. That the petitioner stipulated to redesigning of the parking area as recommended by the Development Services Department. ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commission finds and deter.mines that the prbpo.sal would have no sigaifi- canC environmental impact and, therefore, recommends to the City Couhcil Chat Exemption Declaration Stal•us be granted. -1- ~ ~ NOW, THEitEFORE, BE IT RESOLVED that the Anaheim City Plenning Commission doea hereby grant subject Petition fur Conditional Use Permit, upon the fo7.lowing conditions which are hereby found to be a nccessary prerequisite to the preposed use of the sub3ect prop0rty in order to preserve the safety and general welfare of the Citizena of the City of Anaheim: (1) That the owner(s) of subject property shall deed to the City of Anaheim a strip of land ten feet in width from the centerline of the alley for alley widening purposes. (2) That the existing structure shall be brought up to the minimum standards of the City of Anaheim, including the Uniform Buil3ing, Plumbing, Electricsl, Housing, Mechanical and Fire Codes as adopted by the City of Anaheim, (3) That trash storage areas shall be provided in accordance with appro~~ed plans on file with the office of the Pirector of Public Works. (4) That all air conditioning facilities ahall be properly shielded from view, and the sound buffered from adjacent residences, (5) That aub3ect property shall be served by underground utilities. (6) That the final parking plan shall be approved by the Development Services Depart- ment and any landscaped areas in the parking area shall be protected with 6-inch high con- crete curbs and concrete wheel stops shall be provided foz parking spaces as required by the Development Services Department. (7) That aubject propprty sha11 be developed substantially in conformance with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, 3 and 4 pro- vided, however, that the parking proposed to the rear of the building shall be redesigned and approved by the Development Services Department me stipulated to by the petitioner,, (8) That CondiCion No. 1, above ment•Loned, ehall be complied with prior to the com- mencement of the activity authorized under thia resolution or prior to the time the build- ing permit is issued, or within a period of one;.year from date hereof, whichever occurs first or such further time as the P13nning Commission may grant, (9) That Condition Nos, 2, 3, 4, 5, 6 and 7, above mentioned, shall be complied with prior to final building and zoning inspections. (10) That there shall be no retail sales of vehicles unleas they are a.part of the lease agreement for a new vehicle and that there shall be no advertising of automobilea for sale as stipulated by the petitioner.
