PC 72-35RESOLUTI01~. nr ~_~S _~_ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT 1~82 BE DENIED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Con- ditional Use Permit feom COLLINS LIMITED PARTNERSHIP: DAVID S. COLLINS, GENERAL PHRTNER, 1077 West Ball Road, Anaheim, Califorr.ia 92802, Owners of certain real property situ- ated in the City oi Anaheim, County of Orange, State of California, descrtbed.as be- ginning at a point on the South line of West Broadway which said point is 40 feet 9outh of a point which is 132.88 feet East of a cement momisent marking the Northwest corner uf Lot 47 of "Anaheim Extension", as sh~wn on a Nap of Survey made by Wm. Hamel and filed for record with the County Recorder of Los Ange2es County, California, said point being the int.ersection uf the South line of West Aroadway with the West line o~ Adams Street, running thence South 0° 10` West along the West l.iue of said Adams Street and the continustion thereof 455.75 feet to the South line of the tract of land conveyed to the Anaheim Manufacturing Company oy deed recorded November 12th, 1920 in Book 378, Page 396 of Deeds; thence South 88 57' West along said South line 100.40 feeY. to a point on the East line of the right of way of tne Los Alamitos Branch of the Southern Pacific Railway; thence North 0° 09' West along said East line 248.44 feet to a point an3 continuing along said right of way liae on a curve Northeasterly with a rad?.u~ of 352.25 feet to an intersection on the South line of said Broadway Street; thence North 88° 55' East along said Socth line 34.44 feet to the point of beginning ; and WHEREAS, the City Planning Commission did hold a public hearing at the CityHali in the City of Anaheim on February 23, 1972 at 2:00 o'clock P.M., notice of seid public heering having been duly given as required by lew and in eccocdsnce with the provisions of the Anaheim Municipel code, Chapter 18.64, to liear and consider evidence foc end ageinst said proposed conditional use and to inaestigete and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigotion, and study mede by itself and in its be- helf, and after due consideration of ell evidence and repods offered at said hearing, dqes find and determine the following facts: 1. Thet the pcopased use is properly one for which a Conditional Use Permit is anthorized by ~o~3e Section 18.64.020(3-j-6), to permit a privaee recreetion center, including, live P~nd film entertainment, public and private dar:cing, and other recreation and entertainment activities. 2, That the proposed use will adversely affect the adjoining land uses arid the development of the area in whi.ch it is proposed to be located. 3. That the size and shape of the site proposed for the use is not adequate to allow the full developmer.t of the proposed use in a manner not detrimental to the par- ticular area nor to the peace, health, safety, and general welEare of the Citizens of the City of Anaheim. 4. That the granting of the Conditional Use Permit under the conditi.ons imposed, if any, will be detri.mental to the peace, health, safety, and genera! welfare of the Citizens of the City of Anaheim. 5. That 185 parking spaces were rtquired and applicant stal•ed onl/ .'3 were available. 6, That the Fire Department recommended that the use cease immediately due to ex- L-remely poor pedestrian and vehicular nccess and tlie res~lting hazards to life. 7. That the manner of crowd management and control by the operata: is not conducive to the safe operation of the facili~p 8. That three pers~ns appeared in opposition. CI-D -1- NOW, THEREFORE, BE IT RESCLVED that the Anaheim City P1.enning Commiesion does hereby deny subJect PetiUon for Conditionel Use Permit on the besis of the aEorementioned findings.
