PC72-47 A RESOLUT:ON OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM kECOMMENDING TO T}lE CITY COUNCIL OF TH~ CITY OF ANAHEIM THAT PETITION FOR RECLASSIBICATION NO. ~~ "~Z"31 BE APPROVED WHEREAS, the City Plenning Commission of the City of Anaheim did ceceive a verified Petition for Reclessifica- tionfrom CLARENC~ WAGNER, 822 South Sunkist Street, Anaheim, California 92806, Owner; ANN T, MADISON, 600 South Harbor Boulevard, anaheim, California 92805, Agent of certain real prop- erty situated in the City of Aneheim, County of Orange, State of California,described as Parcel 2 as shown on a parcel'map'filed in Book 23 Page 7 of Parcel 2Saps in the office of the County P.ecorder of said county. ; end WHEREAS, the City Planning Commis;ion did hold a oublic hearing et the City Hell in the City ef Anaheim on March 20, 1972, at 2:00 o'clock P.M. notice of seid public hearing heving been duly given ns required by law and in accordence with the provisions of the Anaheim Municipal Code, Chepter 18.72, to hear end consider evidence Eor and against said propused reclossificetion and to investigete and make findings and recommendetions in connection therewith; and WHEREAS, seid Commission, efter due inspection, investigation, and study made by itself e~,d In its behelf, end after due consideretion oE all evide:ue end reports oEfered et seid hearing, does find end detecmine the following fects: 1. Thet the petitioner proposes a reclassificetion of the above described property from the R-A, AGRICULTUR4L, ZONE to ehe R-1, ONE rAMIL_ PL•'SILENTIAL, ZGNE. 2. That the prooosed reclassification is in conformance with the land uae deaignatior. of the Anaheim General Plan. 3. That the proposed reclessiftcetion of subject property is necessery and/or desirable for the orderly and pco- per development of the community. 4. Thet the pcoposed reclessificetion of subject property does properly relate to the zones and their permitted uses localiy esteblished in close proxlmity to subject propr.rty end to the zones and their permitted uses generally estab- lished throughout the community. 5. That Llie proposed reclassificatinn of sutject property requires the dedical•ion and improvement of abutting streets in accordance with the Circulation Element af the General Plan, due to the anti.cipated increase in traffic which will be generated by the intenaification of land use. R-A -1- NOW, THEREFORE, B~ RESOLVED that the Aneheim City Pl~ng Commission does hereby recommrnd to the Ciry Gouncil of the City of Meheim thef aubject Petition for Reciassificatlon be approved and, by so doing, thet Title 1&Zoning of the Aneheim MunicIpal Code be ame~nded to exclud~ the above descdbed pmperty from the R-A, AGRICULTURAI~ ZONE and to icicorporate said described property into the R-1, ONE FAMILY RESIDENTIAL, ZONS upon the following conditions which are hereoy found t~ be a necessary prerequisite to the proposed use of su.bject property in order to preaerve the safety ar.d general welfare af the Citizens of the City of Anaheim: (1) That a final tract map of subject property shall be submitted to and approved by the City Council and then be recorded in the office of the Orange County Recorder. (2) That the owners of subject property shall pay to the City of Anaheim the appro- priate park and recreetion in-lieu fees as determined tu be appropriate by the City Council, said fees to be paid at the time the building permit is issued. (3) Prior to the introduction of an ordinance rezoning subject property, Condition No. 1, above mentioned, shall be completed. The provisiona or rights granted by this reso- lution shall become null and void by action of the City Cuuacil unless said condition is complied with within 180 days from the date hereof or such further time as the City Councll msy grant.
