NILSSON, M.D., 1720 West Bal~ Road, Anaheim, Califoznia 92804, Owner; CHARLES A. ROSS, 4868 Gondar Avenue, Lak~wood, California 90713, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as the South 96 feet of the North 481 £eet of the East half of the East half of the Southeast quarter of the southeast quarter and the south 96 feet of the north 481 feEt of the East B feet of the West half of the Tast half of the Southea3t quarter of the South- east quarter of Section 14, in Township 4 5outh, Range 11 West, in the Rancho Los Coyotes, as par map recorded in Book 51 Page 11 of Misaellaneous Maps, in the office of the County Recorder of said county. EXCEPT that portion there- of conveyed to the State of California by deed recorded March 5, 1951, in Book 2153.Page 250, Official Records ; and WHEREAS, the City Plenning Commission did hold a public headng at the City He!! in the City of Aneheim on Ap ri 1 3, 19 7 2, at 2:00 o'clock P.M. notice of seid public heacing heving been duly given es requiced by law end in accordence with lhe provisions of the Aneheim Municipel Code, Chepter 18,72, to heer end considRr evidence for end egeinst said proposed reclassifieetion and to investigete and meke findinga end recommendetions in connection therewith; end • WHEREAS, seid Commission, efter due inspectlon, investigetion, and study mede by itself end in its behelf, end efter due consideration of ell evidence end reports offered et sefd heering, does find end determine the following facts: 1. Thet the petitioner proposes e reclassificetion of the ebove described property from tl:e R-A, AGRICULTURAL, 20PIE to the C-1, GENERAL COI~AtERCIAL, ZONE. 2. Thet the propoaed reclasaification of aubject properCy is in conformance with the Anaheim General Plan and land uses in the area. 3. That the proposed reclessiticetion of bubJect property ls necessary end/or desireble for the orderly and pro- per development of the community. 4. Thet the proposed redasaiflcetion of subject propety does properly rclele to the zones end their permitled uses locelly esteblished in cloae proximity to subject property and to the zonea and their permitted uses generally esteb- Ilslied throughout the community. 5. That the proposed reclesaification of subject property doea not require the dedi- cation, but requires improvement, of abutting strr.ete in accordance with the Cirauletion Element of the General Plan, duF to the anticipated increase in traffic which will be gen- erated by the intensification ol` land use, k-A -1- ~ ~ ~ NOW, THEREFORE, EE IT RESOLVED that the Anaheim City Planning Commission does hereby recommend *_o the City Cuuncil of the City of Anaheim that subject Petition for Reclassification be approved and, by so doing, that Title 18- Zoning of tlie Anaheim Municipal Code be amended to ~xclude the above described property from the R-A, AGRICULTURAL, ZONE and to incorporate said desczibed property into the C-i, GENERAL COMMERCIAL, ZUNE upon the following co~dicions which are hereby found to be a necessary prerequisite to the groposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: (1) Thet all engineering requirementa of the City of Ansheim along Beach Boulevard, including preparation of improvement plans and inarallation of all improvements, auch as curbs and guttera, sidewalks, street grading and pawing, drainage facilities, .r other appur- tenant work ahe~l be complied with as required by the City Engineer and in accordance with standard plans and apecificatione on file in the office of the City Engineer; that s:reet lighting facilities along Beach Boulevard ahall be inatelled as required by t~~e Director ~f Public Utilities and in accordance with standard plana and specifications ot: file in the office of the Director of Public Utilities; and that a bond in an amount and zor:n satisfac- tory to the Citq of Anaheim ehell be posted with the City to guerantee the installation of the above mentioned require:,;ents. (2) Thet the owner(s) of aubject property shall pay to the City of Aneheim the sum ~f 15 cents per front foot along Beach Boulevard for tree plancing purposea. (3) That traeh etorege areas shall be provided in accordance with npproved plane an file with the office of the llirector of Public Works. (4) That fire hydrants shall be inetalled as required end determined to be necessary by the Chief of the ~ire Department. (5) That a 6-foot maeonry wall ahall be conetructed along the west property line; and that a bond in an amount and form aetisfactosy to the City of Anaheim shell be poated with Lhe City to guarantee the installatiot~ of a 6-foot masonry wall along the south property lina. (o) That all air conditioning facilities ahall be properly shielded from view, snd the soend buffered from edjacent properties. (7) That any parking area lighting proposed within 120 feet of the R-1 property to the ~aest shall be down-lighting of e maximum height of six feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area. (8) That subject property ehall be served by underground utilities. (9) That droinege of aubject property shall be disposed of in a menner aetisfactozy to Che City Engineer. (10) Pr1or to the intr.oduction of an ordinance rezoning subject property, Condition Nos. 1 and 2, above roentioned, shall be comnleted.
