O. Box 1092, Vista, California 92083, AND AL ROBERTS PLYMOUTH, INC., 1239 South Beach Boulevard, Anaheim, California 92804, Owners; MOBIL OIL CORPORATION, 11001 Valley Mall, E1 Monte, California 91731, Agent of certain real groperty situated in the City of Anaheim, Cou~ity of Orange, State of California, as described in Exhibit A attached hereto and referred to herein as though set forth in full ; and WHEREA.i, the Cily Plenning Commission did hold a public heaxing et the City Hall in the City of Anaheim on April 3, 1972 , at 2:00 o'clock ?.M., notice of said public hearing having been duly given as required by law and in eccocdance with the provisions of the Anaheim Municipal code, Chepter 18.64, to heer and consider evidence for and agair.st said proposed conditional use and to investigate and r.+eke findings and recommendations in connection therewith; and WHEREAS, said Commissien, efter due inspection, investigatian, and study mede by itself and in its behalf, and aFter due consideration of all evidence and repocts offered et said hearing, does find and determine the following Eacts: 1. That the proposed use is properly one for which a Conditional Use Petmit is authorized by Code : Section 18.64.'J20(3-g) to wit: estebliah a caiwash in conjunction with gasoline sales with waivers of: a. SECTION 18.62.090(B-1) - Maximum number of free-standinR siRns. (1 permitted; 4 proposed) b. SECTION 18.62.090(B-2) - Minimum heigh~ of free-standinK signa. (8 feet required~ 8 inches proposed) 2. That Waivers 1-a and 1-b, aoove mentioneii, are hereby denied on the basis that the 9naheim Sign Ordinance provides for adequate aigr~ing. as approved, 3. Thet the proposed use/will not adversely affect the edjoining land uses and the growth and development of the erea in which it i5 proposed to be loceted. es approved, 4. That the size end shape of the site proposed for the use/is adeauete to allow the full development of the proposed use in a manner not detrimental to the particular are¢~ nor to the peace, health, safety, end general welfere of the Citizens of the City of Aneheim. 5.. Cl-G ' 1' ~ ~ ~ NOW, m:?R'rFORE, BE IT RES~'LVED that the Ar.aheim City P2anning Commission does hereby grant in pn~l• snbject Petition for Conditional Use Permit, upon the following conditions which are hereby found to Ue a necessary prerequisite to the proposed use of the subject property in order to preserve the oafety and general welfare of the Citizens of the City of Anaheim: ~~1~ That the owners of sub'ect property shall deed to the City of. Anaheim a strig of land 53 ~e ia width from the center~line of the street along Anaheim Boulevard and a strip of land 53 feet in'width,from the centerline of the street al:ong Ball Road, including 25-fout radius property line retdra, for street aidening purposes. (2) That street lighting facilities along Anaheim Boulevard and Eall Road shall be in- stalled as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the City of An3heim shall be posted with the City to guarantee the installstion of r.he aoove mentioned requirements. (3) That t~e uwners of siibject property shall pay to the City of Anaheim the sum of 15 cents per Eront foot alo~g Fnaheim Boelevard and Ball Road for tree planting purposes. (4) That erash storage areas shall be provided in accordance with approved plana on l:ile with the office of the Directar of PuUlic Works. (5) That all air condiCioning £aciliCies shall be properly shielded from view, (6) That a parcel map to record the approved division of subject property be submitted to and approved by the City o£ Anaheim and then be recorded in the office of the Orange County Recor.der. (7) That subject property shall be served by underground utilities. (10) That Condition Nos. 1, 2, 3, 6 and 9, above mentioned, ahall be complied with prior to the commencement of rhe activity authorized under this resolution, or prior r.o the time that the building permit is issued, or witliin a period of 1R0 d~ys from date hereof, whichever occurs first, or such fur.ther time as the Llanning Cormnissiott may grant.
