A RESOLUTION OF THE CITY PLANNING COMMISSION OF 13 SCITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT N0. BE GRANTED
WHEREAS, the City Planning Commission of the City oE Anaheim did ceceive a verified Petition for Conditional
UsePermitfrom SAM and TOKIKO NAKAMURA, 2623 West Lincoln Avenue, Anaheim, Californi.a 92801, ~
Owners; CRAIG GRAINGER, 125 South Claudina Street, Anaheim, California 92805, Agent of cer-
tain real property situated in r.he City of Anaheim, County of Orange, SCate of California,
deacribed in Exhibit "A" attached hereto and referred to herein ss though set forth itt full
; and
WHEREAS, the City Plenning Commission did hold a public heering et the Clty Hall in the City of Anaheim on
April 17, 1972, at 2:00 a'clock P.M., notice of said public hearing heving been duly given as required by
law and in accordence witli the provisions of the Anaheim Municipel code, Chepter 18.64, to hear end consider evidence
for end ageir.st said proposed conditionel use and to investigete and make findings and recommendations in connection
therewith; and
WHEREAS, seid Commission, after due inspection, investigation, and study mede by itself end in its behelf, and
aEter due consideretion oE ell evidence end ceports offered et said hearing, does find and detertnine the following facts:
1. Thet the proposed use is properly one foc which e Conditlonel Use Permit is authorized by Code
Section 18.40.060(e) to wit: eatablish a semi-enclosed restaurant.
2. That the proposed use will not edversely aEfect. the edjoining land uses end the growth end developnent of
the erea in which It is proposed to be located.
3. That the size end shepe oE the site proposed for the use is edequete to allow the full development of the
plopnsed use in e manner not detrimentnl to the particuler erea nor to the peace, health, sefe:y, and general welfere of
the Citizens oE the City of Aneheim.
4. Thet the grentinq oE the Conditionnl Use Peemlt under the condltions imposed, if any, will not be detrimental
to thc pence, health, safety, end generel welfare of the Citizens of the City of Anaheim.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Comm:asion does hereby
grant subject Petition for Conditional Use Permit, upon the following conditions which are
hereby found to be a nPCessary prer!:quiaite to the proposed use of the subject property in
order to preserve the safety and general welfare of the Citizens of the City of Anaheim:
(1) That street lighting facilities along Ltncc'.i~ Avenue, ahall be installed as re-
quired by the Director of Public Utilities and in accordance with standard plans and speci-
fications on file in the office of the Birector of Public Utilities; and that a bond in an
amount and form satisfactory to the City of Anaheim shall be }~osted w~th the City to guar-
antee the installation of the above mentioned Lequirements.
(2) That the ownera of subject property shall pay to the City of Anaheim the sum of
15 cents per front foot along Lincoln Avenue for tree planting purposes.
(3) That trash storage areas shall be provided in sccordance with approved plans on
file ~aith the office of the Director of Publie Worka, .
(~S) That al:t eir conditioning facilities shall be properly ahielded from view, and
the sound buffered from adjacent properties.
(5) That a parcel map to record the approved division of subject property be submit-
ted to and approved by the City of Anaheim and then be recorded in the office of the Orange
County Recorder.
(6) That aubject property shall Ue served by undergrouad utilities.
(7) ThAt drainage of aubject property shall be disposed of in a manner satiafactory
to the City Engineer.
(8) That the developer shall pay water connection assesaments as determined by the
Director of Public Utilitiea.
(9) That a community driveway agreement shall be recorded for the westerly driveway
as required by the Ci*y Engineer.
(10) That subject property shall be developed substantially in accordance with plans
and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3 and 4.
(11) That Condition Nos. 1, 2, 5, 8 and 9, above mentioned, ahall be complied with
prior to the commencement of the activity authorized under thie resolution, or prior to
the time that the building permit ia issued, or within a period of 180 days from date here-
of, whichever occur.s first, or such further time as the Planning Commission may grant.
(12) That Condition :~os. 3, 4, 6, 7 and 10, above mentioned, shall be complied with
prior ~o final building ~nd zoning inepections.
