RES.OLUTION NO. 71R-13
A RE.sOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING VARIANCE NO. 2222.
WHEREAS, after a request for variance by Ralph.
Wheaton, Owner; William S. Phelps and James 'K. Schuler and
Associates, Agent, was received, a public hearing before the.
Planni~g Commission of the City. of Anaheim was held upon due
and proper notice as a result of wh.ich Variance No. 2222 was
granted covering the followi.ng de.scribed property:
Parcel 1.
Be.ginning at the Southe.asterly corner of the Wester.ly
rectangular 1/2 of Lot 4 of the "Orchard Park .Tract,
Map Book 7, page 6 of Miscellaneous Maps, .records of
Orange County, California; and running thence Weste.rly
along the Southerly line of said Lot 55 feet;. thence
Northerly in a stra~9ht line to a point in the North.e.rly
line of said lot (being a point in the South 'line of
South Street as shown on said Map), which said point is
60 .feet Westerly measured along said Northerly line of
said lot from the Northeaste.rly corner. of said Westerly
rectangular 1/2 of said lot; the.nce "East'erly along the
Northerly line of said Lot 60 feet to the Northeasterly
corner; thence Southerly along the Easterly line of said
Weste.rly rectangular 1/2 337.98 feet, more or less, to
the point of beginning.
Parcel 2:
Beginning at the Southeasterly corner of the Westerly
rectangular one-half of lot 4 of the Orchard Park Tract,
as shown on a map recorded in Book 7, page 6 of Miscel-
laneous Maps, records of Orange County, California; and
running thence Westerly along th.e Southe'.rly line of said
Lot 4, 55 feet to the true point of beginning; thence
continuing along said Southerly line 29.50 feet; thence
North 150 191 OS" West 308.03 feet, more or less, t.o a
point in the North.erly line of Lot 4, said point be.ing
South 740 30' 0011 West 84.50 feet from the Northeasterly
corner of the Westerly rectangular one-half of said Lot
4; thence North 740 30' oon East along said Northerly
line 24.50 feet; thence Southerly 308.08 feet, more or
less, to the true point of beginning.
All of the above described property is situated in the
State of Californi.a, County of Orange, City of Anaheim.
WHEREAS, the.reafter I .wi thin the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
public hearing noticed and he.ld as prescribed by law and as
a result thereof the City Council does hereby make the follow-
ing findings:
1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to

other property under identical zoni~g class"ifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(l) above, strict application of the zoning code
deprives the property of privileges 'enjoyed by
other property under identical zoning classifica-
tion in the vicini.ty.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of tne City of Anaheim, that said variance "be granted subject
to the following conditions:
1. That this variance is granted subject to the
completion of Reclass'ification No. 70-7l-l9.
2. That subject property shall be developed subs.tan-
tially in accordance with plans and specifications
on file with the City of Anaheim, marked Exhibit.s
Nos. 1 and 2, Revision No.1.
BE IT FURTHER RE.SOLVED th.at the. City Council hereby
reserves the right to revoke such variance permit for good
cause or failure of said owner, his heirs, su'ccess'ors or
assi.gns to comply wi.th the Anaheim Municipal Code and regula-
tions and the .conditions herein. Said variance is granted for
the term prescribed by the Anaheim Municipal Code unles.s other-
wise specified herein.
THE FOREGOING RESOLUTION is approved and signed by me
