PC72-84 ~ ` `~ A RESOLUTION OF THE CITY PLANNiNG COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT 1308 BE DENIED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition Eor Con- ditional Use Permit from Tli~ SOUTHLAND CORPORATION, 2828 North Haskell Avenue, Dallas, Texas 75204, Owner; S, RICNMOND DOLE, Assistant Secretary, The Southland Corporation, Post Office Box 698, La Mesa, California 92041, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: That portion ~f LoC S of Anaheim Extension, as per Mep of Survey made by TJilliam Hamel, deted and scknowledged on December 11, 1868 by A. Robinson, Trustee and fiT'ed in the office of the County Recorder of Los Angeles Coiinty, described as followa: Beginning at the South- west corner of said Lot 8, said corner being recognized as the intersection of the center line of Santa Ana Avenue, 49.50 feet in width, with the Easterly line, or the extension thereof, of East Streec, 66 feet in width, and running thence North 13° 23' O1" West along said Easterly line of Eaat Street, 201.50 feet; thence North 74° 31' T5" East parallel with said center'line of Santa Ana Avenue, 110 feet; thence South 15° 23' O1" Eaet paral- leY with said Easterly line of East Street 201.5U feet to said center line of Santa Ana Avenue; thence South 74° 31' 15" West along said center line, 110 feet to the point of beginning. EXCEPTING THEREFROM the Southeasterly 24.75 feet included within the North- er?y half of Santa Ana Avenue ; and IVHERCAS, the CityPlanning Commission did hold e public heering et the CityHall in the City of Anaheim on May 1, 1972 at 2:00 o'clock P.M., notice oE said public hearing heving been duly given as requixed by law and in accordence with the provisions of the Meheim Municipal code, Chepter 18.64,to hear and consider evidence for e.nd against seid pcoposed conditional use and to investigate and make findings end recommendations in cannection therewith; end WHERF.AS, seid Commission, efter due inspection, investigetion, ar.d study mede by itself and in its be- half, and after due consideretion oE a11 evidence and reports offered at seid hearing, does find and determine the Eollowing facts: 1. That the proposed use is properly one for which a Conditional TJse Permit is authorized by Code Section 18.40.06Q(c) to wit: establish gasoline pumps in conjunction with an existing food store and located within 75 feet of residentially zoned and developed property. 2. That the Planning Commission recommended disapprova?. of the original C-1 reclassification request as being an undesirable use in Che center of a residential area. 3. That there has been n~ lan3 use change since the last time an idzntical request had been denied on this property by the Planning Commission and City Council to warrant ~avorable consideration of subject petition •st this time. 4. That approval of subject petition would be granting a privilege not enjoyed by other similar businesses throughout the city and would establish a precedent for similar requests. 5. That approval o£ subject petition would aompound an already serious vacancy factor since 20-25~ of the existing se~vice stations are now vacant. 6. That approval of subject petition would create additional traffic problems to the adjoining res.idential uses as well as odors and noises from servicing the vehicles with gasoline. 7. That one person appeared and submitted a petition signed by eleven adjoining residents, all in opposition to subject petition. CI-D ' 1- ~ ~ NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Planning Commission does hereby deny subj~ect Petition for Conditionnl Use Permit on the besis of the aforementioaed findings.
